McCARTHY 1. PROBLEM: Enclosed are 6 letters dealing with the claim of Mrs. T. J. McCarthy, 32 Sorrento Court, Danville. Mr. McCarthy believes the Sanitary District should reimburse her for the side sewer expenses she has paid over past years. 2. BACKGROUND: After several talks with Mrs. McCarthy about her problems, it was decided to expose and locate the source. We determined that her side sewer had been damaged - obviously during subdivision con- struction by the water line installer. We made the repair and requested East Bay Municipal Utility District to pay the McCarthy's and this District for the costs incurred. East Bay Municipal Utility District refused and we did not pursue the matter, since we had corrected the problem. We agree with East Bay Municipal Utility District as to the original responsibility and, since Consolidated Companies still has $1,466.85 due in future rebate collections, we think that we can still hold them responsible moratarily. 3. RECOMMENDATION: Pay the McCarthy claim ($425.95) and advise Consolidated Companies that we will deduct $638.10 from their rebate recovery. Respectfully submitted, W. C. These are allowable costs for Grant participation pursuant to the maintenance of records showing the basis for such charges, including necessary time records and other substantiating data. To facilitate the accounting for the above cost, it is requested the sum of $260,000 be authorized for the Water Reclamation Plant con- struction management fund. Horstkotte, Jr. - General Manager -Chief Engineer SUBJECT: REPORT ON LID-54-2-CLIPPER HILL AND KUSS ROAD AREA A. JOB STATUS Notice to Property Owners (Exhibit A), mailed the latter part of August, 1973. The notice indicated that the official hearing on the Local Improvement District will be held on September 20, 1973. The estimated unit of assessment is $4,752.21. On September 20th we will have bids from sewer contractors which may adjust the unit of assessment up or down from the estimated assessment. There are 49 individual county parcels within this local improvement district. B. SANITARY DISTRICT INVOLVEMENT As of June 30, 1973 we have $37,014.25 on our books against this area. The first charges were posted in May, 1968. Prior to 1969 the Sanitary District staff, guided by the Board policy, permitted the District permit counter to stamp owner's proposed plot plans after the staff determined the status of the sewer service available in the area. Under this commitment between the Sanitary District and the County Health Department, there are presently nine temporary septic tank permits issued by the County in this area. Contra Costa County Health Department letter dated January 27, 1972 (Exhibit B), explains the procedure we used at that time. C. E.I.R. STATUS The Board of Directors have reopened the hearing on the Environmental Impact Report and we have sent notices out to the property owners (Exhibit C) inviting them to attend a meeting to be held September 6, 1973. The following exhibits are attached for background information for the E.I.R. hearing: Exhibit D = Summary of action on E.I.R. report. Exhibit E = Notice sent to all property owners indicating that E.I.R. has been prepared for their area, which was dated June 26, 1973. August 28, 1973 Page Two Exhibit F = Excerpts from the Board Meeting of June 14, 1973. The Board authorized filing of Notice of Completion on E.I.R. Exhibit G = Excerpts from the Board Meeting of August 16, 1973. The final E.I.R. was filed with the Board and approved. D. PSA-29 TO LID-54-2 BACKGROUND The following excerpts are attached to highlight some of the history on the formation of PSA for the Clipper Hill and Kuss Road area. These exhibits are in chronological order to give the Board a running account chronologically: Exhibit H = An explanation of Board policy prior to 1969 concerning PSA's. Exhibit B = Contra Costa County Health Department letter dated January 27, 1972 which established L.I.D. procedure between the District and the County prior to 1969. Exhibit I = Excerpts from the Board Meeting dated November 18, 1969. A discussion of improving the District's public relation image in handling proposed L.I.D.'s. Exhibit J = Excerpts from the Board Meeting of May 7, 1970. A new type of hearing that was conducted by the District Board to determine the present attitude of the property owners in PSA29, Clipper Hill and Kuss Road area. Exhibit K = Excerpts from the Board Meeting May 14, 1970, The Board recommended that PSA29 be postponed. Exhibit L = Excerpts from the Board Meeting of February 17, 1972. The staff authorized to proceed with PSA29 for the formation of a L.I.D. in 1972. Exhibit M = As authorized by the Board, the attached postcard notice was sent to all property owners within the proposed L.I.D. Exhibit N = Excerpts from the Board Meeting of May 3, 1973. The staff was again authorized to proceed with L.I.D. 54-2 (PSA29) and sent out the required official notices for August 28, 1973 Page Three the public hearing which is now scheduled for September 20, 1973, so that the property owners may have the opportunity to be present to determine if they want to proceed with the installation of sewers for this area. Said Resolution of Intention was adopted pursuant to the Municipal Im- provement Act of 1913 and bonds are to be issued upon the unpaid assessments pursuant to the Improvement Bond Act of 1915, and proceedings have been had by the District Board pursuant to Division 4 of the Streets and Highways Code. Attn: Board of Directors Dear Sir: Re: Establishing an LID Procedure Since the creation of the CCCSD in 1945, the Health Department has worked closely with your staff and the Board, in initiation of PSA and LID. These joint efforts and procedures have been most effective in eliminating existing area health problems as well as preventing the creation of new areas where health problems will result. The adoption by the Board of a revised policy in this matter is resulting in precisely the creation of those unsanitary conditions which we were successful in avoiding over the years. In the past, most of the PSA's have been initiated by this Department in that septic tank problems and resi- dential developments become known to this Department early in developmental stages. There are several procedures that bring this about. First, in communities which have been developed on septic tank systems we are the first ones to be advised of failure of these systems, either by the occupant or a nearby neighbor via complaints. In such cases, where it is necessary to attempt to correct a failing system, the owner is required to obtain a repair permit from this Department, if sanitary servers are not available at the time. These records, coupled with information as to the frequency of septic tank cleaning (pumping out) in the area, give us a good index of problems as they are de- veloping. Information as to frequency of septic tank -2- pumping is received by the Health Department in monthly reports submitted by firms which clean and pump out septic tanks. This is an effective means for the Health Department to determine areas in which health problems exist; and may also serve as a "quieting effect" on those individuals who maintain they have no sewage disposal problems. Further, this Department determines approval or dis- approval of all Minor Subdivisions (4 or fewer lots) where development is proposed, utilizing septic tanks as a means of sewage disposal.. When such property is located within the Sanitary District boundaries or within the ultimate service area of the district, and does not have sewer ser- vice available to the site(s) at the time, the owner is required by the Health Department to sign a petition re- questing such service and indicating his willingness to participate in sewering at some future time. This is required of all applicants whose property may ultimately Fe ome serves ,Ty CCCSD, prior to accepting applications for individual septic tank permits by the Health Department. In addition, this Department has refused in certain situ- ations to issue permits for new construction, resulting in "rejects" of these properties until sewers become available at some future time. In all of these instances, the prop- erty owner has no alternative but to wait for his neighbors to "decide` that he can build. By using the foregoing information and knowledge, we can predict problem areas and needs for sewering and assist your staff with information for the Proposed Sewering Area Index, an informational sanitary sewering schedule, where PSAts evolve and ultimately terminate in LID's. Thus, projected sanitary sewer planning results in an orderly ex- tension of sewers before any serious health problems develop. In the past when LIDs were formed (on paper) and your District staff stated that sewers were definitely to be in- stalled within a one to two year time, this Department has voluntarily issued temporary septic tank permits to property owners, in orderto allow him to proceed with building con- struction. In these cases, the applicant is informed that the temporary.septic tank system is to serve only until sani- tary sewer connection could be made. NOTE: Most of the properties on which these conditional permits were issued would not have complied with the County Septic Tank Ordinance. In fact, some of these lots had been previously "rejected_" for development on septic tank systems. This was the situation which pertained in the case of PSA 29. -3- UP There are presently nine (9) expensive homes ($50,000 - mmoW40 to $100,000) that were a owes to be constructed with interim gip' septic tank systems pending installation of sewers within one year. None of these properties have sufficient area for addition or expansion. In conclusion, I request that your District Board seriously consider reactivating and implementing as necessary in cooperation with the Health Department the procedures which have been effective in the elimination and prevention of health nuisances arising out of septic tank installations. The home of the author ,Eugene O'Neill is situated on this land. The 1,000 acres is made up of nine County.Assessor's parcels with a .total assessed value of $211,820.00. The land and home is presently on the market with the asking price of 1.8 million dollars...Because of historical value of the home, the ruggedness of the to and the Proximity to the Las Trampas Regional Park, there has been some public expression by individuals and newspaper editorials of the desirability of including .this land in the Regional Park District and the undesirability.. of bringing sewers any closer to the Corduroy Hills land as this may create. a development feasibility. The East Bay Regional Park District was contacted and it was learned that they are developing a master plan which is scheduled to be completed by the end of 1973 and adopted by the Board early 1974. At the present time, approximately 40 sites are under study for possible inclusion in the plan. for future park acquisition. Two of these sites are in the vicinity of Las .is the Corduroy Hills land. Should the Trampas Regional Park, one of which Corduroy Hills land be acquired by the Park District, it would undoubtedly be included with and classified aswilderness as is the Las Trampas Park. In this _case, sewage disposal would be a small problem and could be accom- plished without a public system. The home, whether purchased.by the Park District or by others, could connect to the project 1,000 feet away. The Corduroy Hills land is within an area designated,by the Countyts- "General Plan" as low density residential development which anticipates a rezoning from the existing "A-2" to a zoning of R-20 to R-40, the same as that of the project area. Development of the Corduroy Hill land may be. feasible, however, some difficult and expensive problems exist such as water service, road access and sewer service. Approximately 30/, of the land area drains -through the project. This 30%, because of the topography, would probably develop to the highest density while some of the land to the north may remain undeveloped. The sewers proposed by the project have an ultimate capacity to serve 275 !-comes through each of the 6-inch reaches and 450 homes through the 8-inch 5 G line which collects the 6-inch reaches. The number of homes which could be built on the Corduroy Hills property.is unknown at this time. It is con- ceivable that the majority of the homes built on this land could sewer through the proposed project sewers, and based on the County's General Plar_ could easily exceed what could be`allowed through the project sewers. In allowing any connections from Corduroy Hills to the sewer system, the District planning would have to recognize the possibility of the development of the total property at densities based on the County's General Plan. Therefore, any connections would start the planning for the installation of parallel sewer mains downstream of the development which would have to be financed by the developers of,Corduroy Hills. It is doubtful that the project sewers would relieve the developers of Corduroy Hills land of any sewering expense as the financing of a parallel line -would be required." Mr: Kenneth Samuels, 700 Clipper,Hill Road, Danville, California, adc,essed the board and stated that a health problem did exist in the Local Improvement District No. 54, Schedule 2, area. Mr. Samuels commented that the Corduroy Hills area. was not germaine to the issue of solving the sewage problems of the Schedule 2 area, particularly as the Corduroy Hills area was unlikely to be developed in the.foreseeable future because of certain financial. encum— brances and type of terrain. Member Gibbs commented that it had been the policy of the Board to Oppose installation of sewers that .could service "green belt areas" as defined by the County Board of Supervisors. However, District policy was to. provide sewers for those already developed areas if the people so desire them and it was economically feasible. Mr. Angelo explained that. personnel of the Health Department have always coordinated efforts with the staff of the District regarding formation of Proposed'Sewering Areas, Local Improvement Districts and to alleviate health problems. He indi cated that, prior to issuance of temporary permits for septic tanks, liaison was established with District staff to determine and develop a coordinated plan for providing sewer service for affected areas. Mr. Angelo stated that, in addition to the program of coordinated planning, with the District staff, the Health Department, through ordinances and regulations has raised standards for septic tanks. Mr. Gene Green, County Health Department, addressed the.Board and stated that, in 1969, the District provided the HealthDepartment with correspondence indicating the District's intention to provide sewer service for the Schedule 2 area. Member Mitchell, that Resolution No. 73-87 be adopted. 8 Jalutary 20, 1972 y MEMORANDUM TO: THE HONORABLE MEMBERS OF THE BOARD OF DIRECTORS SUBJECT: Establishing Local Improvement District Procedures 'the District staff needs guidance from the Board on the procedure, to he followed for proposed sewering areas (P.S.A.) which precede formation of a -Local Improvement District (L.I.D.). Prior to 1969, the Sanitary District staff, guided by the Board policy, automatically proceeded with the formation of a proposed L.I.D. to sewer the �4% �• P.S.A. area when the District staff had received a 60% sign-up assessed valu- ation. The Board, at the meeting of November 18, 1969, established a new policy for future P.S.A.'s and L.I.D.'s. In line with the Board's new policy, a meeting was held with our staff, County Health Department staff, Mr. Jerry Laster, and Mr. John Bohn to co- ordinate our efforts and to establish a procedure for future P.S4A.',s. Be- cause of the numerous options, I have asked the above parties to be present at the February 3, 1972, Board Meeting to explore this matter further. The procedure requires a joint action with the County Health Department and I have asked them to submit an outline of the procedure they follow since they initiate approximately 90% of our P.S.A.'s (see.H�alth Department attachments), To supplement the Health Department. P.S.A. formation procedure, we recommend the following procedure be adopted by the District: 1. The owner whose property is located within our.Sanitary District boundary or within the ultimate service area of our District and does not have sewer service available to the proposed site, is required by the County Health Department to explore, with the Sanitary District, the availability of sanitary sewer service. The District Permit Counter -reviews the application and stamps the owner's proposed plot plan with one of three stamps (copies of Stamps 1, 11 and -III attached) after the staff determines the status of the sewer service available as outlined in the County Ordinance Section 4640 (e). The District Permit Department will require the applicant to sign. a petition for annexation if he is outside of the Sanitary District boundary and a petition for the Construction of Improvements. 2. As we accumulate these petitions and other miscellaneous requests, we will group the parcels into a P.S.A., and, if it is determined that this may develop into an active area, we will: establish a proposed boundary; lay out a tentative sewer system to serve the individual properties within the P.S.A.; advise the County Health Department and in some cases, seek Board approval for annexation. He explained that the District had a legal limit of 7% for the sale of bonds to cover the unpaid assessments and at the present time bonds could not be marketed at 7% or less according to latest municipal bond interest rate index published in the Wall Street Journal. Mr. Green, of the County Health Department, stated that temporary permits for septic tanks had been issued to property owners in the area, subject to their connecting to sewers when available. He said petitions have been signed requesting sewer service. PROBLEM: Five homes are presently connected to an existing six-inch sewer. The six-inch sewer crosses private property without an easement. This sewer is a continuous maintenance problem. 2. BACKGROUND: The sewer was installed in 1951. It appears that a portion of it is flat (based upon an engineering investigation). Horstkotte, Jr., General Manager -Chief Engineer SUBJECT: DISTRICT SEWERING PROJECT - 2100 RUDGEAR ROAD A & P Pipeline Construction Company started this sewer project the early part of July, 1973. The job has progressed at a very slow pace with numerous problems and violations which we have brought to the contractor's attention. On advice of legal counsel, we sent Certified, return -receipt -requested letters to Mr. A. Poipao and his bonding company, U.S. Fidelity and Guaranty Co., on July 20th, 24th, 31st and August 7th, advising them of our dissatisfaction with his operation. The completion date for this project is October 1, 1973, and I think it will be impossible for him to comply. The Contractor is now ready to start on the 18-inch trunk sewer line in Rudgear Road, westerly of the existing State Highway 680. Under the State Utilities Encroachment Permit, any work under the State Freeway has to have the concurrence of Gordon H. Ball, the State's contractor on the current highway project. The State Contractor indicated that our contractor could only work within this area after 4 p.m. on their normal working days or on week ends or holidays. Mr. Poipao has asked for $1500 to complete this section of sewer line due to the conflict with Gordon Ball's freeway operation. He intends to do this work on weekends. He is also asking for an extension of time until October 31, 1973. We have discussed this problem with Jim Carniato and would like to discuss this with the Board on September 6th in EXECUTIVE SESSION. PROBLEM: Mr. Peter Meagher has submitted plans for a sewer main extension to serve his property in Orinda, Job No. 2370. The proposed alignment of this main crosses the Simon property, Parcel No. 2. The Simon's have refused to grant the necessary sanitary sewer easement. 2. BACKGROUND: Mr. Meagher's septic tank has failed. There is additional property adjacent to the Meagher and Simon properties that could benefit by a gravity sewer main extension. Mr. Simon's property is presently sewered. The location of Mr. Meagher's property is such that the proposed sewer must cross Mr. Simon's property. Mr. Meagher has deposited the required $1,000 with the District. 3. They have asked us to explore the possibility of extending the Winton Jones sewer line located northerly of Arnold's Industrial Highway, easterly to the top of the hill (DSP-2395) and also explore the possibility of extending the drive-in theater sewer, lying southerly of Arnold's Industrial Highway, easterly towards State Highway No. 680 (DSP-2396). There may be a possibility that the City of Concord may be able to provide sewer service at a cheaper cost to some of the properties at the eastern terminus of DSP-2396. The State indicated that if this District sewer extension is feasible and within their allowable budget, they will enter into an agreement with the Sanitary District for said sewer extension.
