BAILEY, GENERAL MANAGER ISSUE Authorization from the Board of Directors (Board) is required to execute an agreement for an amount greater than $200,000. BACKGROUND Central San owns and maintains a sewer located in private easements at the Orinda Country Club (Club) and adjacent to Lake Cascade in Orinda. This sewer, originally installed in the early 1950s, is an 8-inch cement -lined steel pipe with mortar coatings, aerial, and built on the side of the lake's dam. The sewer is routinely inspected since it's an aerial crossing with a high consequence of failure as any leak would immediately enter the privately -owned lake. Central San staff reviewed the Club's tennis court renovation project and identified an easement encroachment, resulting in a Real Property Agreement authorized by the Board on July 7, 2022. As a part of the Club's project, a grandstand is to be installed over the existing Central San sewer. Capital Projects has identified the sewer for replacement and determined that the best alternative would be to relocate a portion of the existing sewer that conflicts with the proposed grandstand and install a new sewer at a different location on the property. The sewer relocation would allow for the abandonment of the aerial sewer crossing at Lake Cascade. November 6, 2024 EOPS Regular Committee Meeting Agenda Packet - Page 6 of 64 Page 2 of 6 Overall, the scope of work would consist of installing 560 feet of 8-inch sewers by open cut and directional drilling and abandoning approximately 600 feet of existing sewers and related structures. The project to perform such work was authorized by the Board on February 22, 2024, at which time Lake Cascade Sewer Relocation, District Project 100072 was created. Since then, the new public sewer has been installed. The abandonment of the existing sewer on Lake Cascade will be done separately as the work requires regulatory permits by the Division of Safety of Dams. Staff is in the process of obtaining the required permit. Prior to abandoning the public sewer on Lake Cascade, the privately -owned side sewer for the fitness facility by the tennis courts needs to be rerouted. This was anticipated as part of the project and the Club, as owner, has agreed to include the work within their project and hire a licensed contractor to complete the work. Central San would enter into an agreement with the Club to reimburse the costs of design, permitting, construction, management, and restoration for the side sewer relocation. At the time the project was initiated, the reimbursement cost was within the General Manager's delegated authority. Since then, the length of the relocation has increased from 150 feet to roughly 350 feet. Thus, the cost requires Board authorization to proceed. California Environmental Quality Act (CEQA) The Board declared that the project is exempt from CEQA at its meeting on February 22, 2024. The scope of work for the project has remained the same. ALTERNATIVES/CONSIDERATIONS Time is of the essence as the Club would prefer to enter into an agreement and complete the relocation work prior to the rainy season. The Board can provide alternative directions to staff, if needed. FINANCIAL IMPACTS The total estimated cost for this agreement is $330,000 which includes design, contractor cost, permits, construction management, and contingency. The agreement will be funded under Lake Cascade Sewer Relocation, District Project 100072, which has adequate budget available. COMMITTEE RECOMMENDATION The Engineering and Operations Committee reviewed this matter at its November 6, 2024 meeting and recommended RECOMMENDED BOARD ACTION Authorize the General Manager to execute an agreement in an amount not to exceed $330,000 with the Orinda Country Club to relocate a private sewer under Lake Cascade Sewer Relocation, District Project 100072.
