BAILEY, GENERAL MANAGER ISSUE A Resolution of the Board of Directors (Board) is required to accept Grant Deeds and execute Grant Deeds for District Projects BACKGROUND As part of the joint Walnut Creek/Grayson Creek Levee Rehabilitation project to protect the treatment plant from potential flood hazards, Central San has agreed to grant the Contra Costa Flood Control and Water Conservation District (FCD) fee and easement rights along the Walnut Creek and Grayson Creek Levees abutting the east side of Central San's treatment plant. As part of the same agreement, Contra Costa County (County) will grant Central San fee ownership of Old Imhoff Drive along State Route 4 that abuts the west side of Central San's Martinez campus, giving Central San full control of the property. This exchange would bolster both flood protection along the creeks, and security on Old I mhoff Drive along State Route 4. October 15, 2024 Special REEP Committee Meeting Agenda Packet - Page 3 of 31 Page 2 of 7 ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the Grant Deed from the County or to approve the Grant Deed for FCD. This alternative is not recommended since Central San and FCD would not have the necessary land rights to raise the levees and control perimeter security safety along Old Imhoff Drive. FINANCIAL IMPACTS The property rights will be acquired at no cost to Central San as they are part of an exchange between Central San, the County, and FCD. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on October 15, 2024 and recommended RECOMMENDED BOARD ACTION Adopt the proposed Resolution 2024 - xxx accepting the Grant Deed from Contra Costa County for Old Imhoff Drive, and Resolution 2024 - xxx approving the Grant Deed to the Contra Costa Flood Control and Water Conservation District as part of the Walnut Creek/Grayson Creek Levee Rehabilitation, District Project 7341.
