Horstkotte, Jr., General Manager -Chief Engineer SUBJECT: Claim for Mr. Gordon A. Knapp, Jr., in the amount of $404.76. 1. PROBLEM: Overflow at 62 Hacienda Circle, Orinda, California 94563 Phone: 254-4963 2. BACKGROUND: On Tuesday, March 6, 1973, the District received a call to relieve an overflow at the address mentioned above. Upon arrival the crew found the 6" easement line A-16 plugged 20' upstream from MH. 15 toward MH. 16. The stoppage consisted of roots and was cleared with no difficulty. The District crew cleaned and desinfected throughout. An overflow device has been installed. 3. RECOMMENDATION: This claim comes to $404.76 and it seems to be reasonable for this type of damage. I feel the claimant is entitled to a settlement. Respectfully submitted, Robert H. Bohn, District Counsel FOR: Attorneys Report Board Meeting March 22; 1973 , SUBJECT: Condemnation action against Mr. Charles E. Labat, et ux, 53 Don Circle, Walnut Creek PROBLEM; The District's existing sewer main and manhole serving Mr. Labat and others, encroaches upon the northeastern portion (340 sq. ft.) of Mr. Labat's property. No easement exists, and he wants us to move our facilities, or pay him the amount this would cost (he has an estimate of $1,527.16 from Pioneer Underground, Inc.). BACKGROUND: Recent surveys in this area have located property corners thus alerting Mr. Labat to the fact that our sewer facilities do encroach upon his property. District Counsel has written a letter to attorney for Mr. Labat, offer- ing $100 for the 340 sq. ft. of required easement. RECOMMENDATION: Proceed with condemnation if offer is not accepted. March 22, 1973 MEMORANDUM FOR: HONORABLE MEMBERS OF THE BOARD OF DIRECTORS VIA: G. A. Horstkotte, Jr., General Manager -Chief Engineer SUBJECT: Sludge Contract with 0. E. Einevoll 1. PROBLEM: It is necessary to clear the area now used for sludge processing to allow the contractor for the pending treatment plant modification access for his construction operations. There is a large stockpile of sludge partially processed and ready for sale which has to be removed. 2. BACKGROUND: Mr. Einevoll has held the sludge contract for a number of years and has fully performed his obligations. He has pro- cessed and accumulated the stockpiled sludge in the area designated for him. Because of access and design questions, we were unable to allocate another suitable area until now. To get him to move the stockpile, we are proposing to reduce the franchise payment and pro- vide a new location which will be satisfactory for several years or until sludge is no longer a plant by-product. 3. RECOMMENDATION: Authorize the execution of a revised agreement with Obert Einer Einevoll for exclusive franchise for the removal of sludge (copy attached). Respectfully submitted, W. C.
