SUBJECT: HOLDING BASIN CONTRACT - PROTECTION OF STANDARD OIL
PIPELINES
PROBLEM: The spur railway track fill which is part of the Holding
Basin levee contract crosses Standard Oil transmission pipelines
near the A. T. & S. F. R. R. and these pipelines must be protected
by encasement.
BACKGROUND: We have discussed this problem with Standard Oil as
the attached letter indicates. They will do the work in three
weeks after a four -week notice for approximately $5,000.00. We
believe this is the best approach providing it is started before
the Holding Basin contractor needs the area for his fill operation.
RECOMMENDATION: Authorize notice to start encasement work to
Standard Oil and issuance of a purchase order for $5,000.00 to cover
cost of said work.

SUBJECT: ORINDA TUNNEL ACCESS ROAD - D.S.P. 1372 STATE UT. 485.41
PROBLEM: We do not have all weather access to the west portal of
the Orinda Tunnel. Access is from Bates Boulevard along the free-
way right of way fence to the west portal.
BACKGROUND: The trunk line was relocated for the freeway. The
State has amended utilities agreement 485.41 to include payment for
a rock base road.
RECOMMENDATION: Approval of plans and specifications to construct
a gravel road from Bates Boulevard to the west tunnel portal.

OF THE BOARD OF DIRECTORS

SUBJECT: Proposed District -Concord Contract Cost Sharing Tabulation
PROBLEM: The City of Concord requested terms and an economic
comparison of a contract based on a cost sharing formula
for treatment and disposal of city sewage by this District.
BACKGROUND_: The costs shown on the attached contract tabulation are
based on those used in the District financial plan and the
annexation offer made to Concord. The preliminary contract
calls for a buy -in by Concord and sharing of future costs
on an assessed valuation ratio.
The total cost to Concord over the comparison period is
about $3,000,000.00 more than annexation but they would
retain political and financial control of their collection
system.
RECOMMENDATION: Review the contract tabulation for discussion and policy
direction.

SUBJECT: Lime Recycle Study
On October 5, 1972, under Item 5 of the Minutes of the Regular
Meeting, Mr. Dalton reported the $220,000 cost of the Lime Sludge
Recycling Project had been accepted as an eligible engineering design
cost for the Water Reclamation Project and the Board authorized Mr.
Dalton to execute a contract with the City of Concord.
Under Item 5. a., the Board authorized the Lime Sludge Recycling
Study, but did not include the $220,000 cost in the authorization. In
order to facilitate accounting procedures, it is requested that Minute
Record of a specific $220,000 authorization be made for the Lime Re-
cycling Project.

SUBJECT: ACCEPT EASEMENT SUBJECT TO SPECIFIED CONDITIONS AND
AUTHORIZE PAYMENT OF $2,000 TO DR. AND MRS. NORMAN A.
BALLANTINE - LOCAL IMPROVEMENT DISTRICT 54-3 PARCEL 1R-1
1. PROBLEM: In order to provide sewer service to the Rich Acres Road
area, we must cross the Ballantine property, which already has sewer
sewer service.
They want payment of $2,000.00 and the District to repave
the driveway and be responsible for any slide which may be the result of
construction or maintenance of the sewer.
2. BACKGROUND: Alternate routes have been explored and they both appear
to be more expensive to the District.
3. RECOMMENDATION: Approval.

SUBJECT: GRANT A 20 FOOT EASEMENT TO P.G. & E. - JOB NO. 1546
1. PROBLEM: We have asked P. G. & E. to relocate their existing 20 foot
easement 5 feet westerly of its present location, which they have agreed
to do.
2. BACKGROUND: This easement is located in the old Sacramento Northern
Railroad right of way. By moving this easement it will eliminate an
unnecessary 5.0 foot gap which exists between the existing 20 foot P. G. &
E. easement and the 20 foot strip of land we intend to grant to East Bay
Municipal Utility District.

SUBJECT: DISTRICT PARTICIPATION IN SLIDE REPAIR ON MUTH DRIVE - JOB 2338
1. Slide repair work has been completed at 39 Muth Drive, Orinda. The owner,
Mr. Ted Yeghoian, has sent the attached letter requesting financial participation
in the repair of the slide.
If the slide had not been repaired, it was planned to install a residential
pumping system or a suspended temporary main to serve Mr. Yeghioan's house and
Mr. Saunders house immediately to the east. Since permanent gravity service has
been restored to both houses, the installation of the pump, or temporary sewer,
will not be required.
2. It is recommended that the District contribute $3,500.00 to the cost of the
repair of the slide which amount of money is the amount we estimate a temporary
solution would have cost the District over the next year. Payment to be made
only after execution of a document relieving the District of all slide respon-
sibility.

SUBJECT: Draft Ordinance on disposal sites
1. PROBLEM: How to establish regulatory control over disposal sites
within the Sanitary District in such a manner as to meet requirements
of private enterprise and still .protect the.. District's interest.
2. DISCUSSION: a. It is believed, the major concern.-of"private enter-.
prise (Acme Fill Corp.)Js that if the District adopts an -ordinance regu-
lating disposal sites, incorporated within the language of. that 'ordinance
will be District authority to preclude disposal of any "solid waste generated
outside District boundaries into disposal sites located within the Sanitary
District. This is of primary concern to. the owners of Acme Fill Corp. as
three of the shareholders of that corporation (Mt. View Garbage, Concord
Disposal and Crockett Garbage) utilize the Acme site even though the areas
they service are outside of the District. A fourth shareholder, Pleasant
Uill-Bay Shora Disposal services appro wately five hundred residents within
the District. The majority of its customers reside outside the District in-
cluding the tam of Benicia in Solano County and West Pittsburg. In addition,
it is believed, some of the other shareholders of Acme Fill Corp., including
District franchisees, service a number of residents outside District boundaries.
Related to the existing situation, in the event.a collection agency had the
opportunity or wish to expand its area of operation, conceivably this area
could be outside District boundaries. As a shareholder of Acme Fill, that
agency would normally expect to have access to the Acme Fill site.
b. The District objective is to preclude another govern-
mental agency from exercising regulatory control over activities within the
District which are within its perview and secondly, to protect the interest
of the public which it serves.
3. CONCEPT: Adopt anordinance which:
a. Requires all existing disposal sites and future disposal
sites within the Sanitary District to obtain a permit for such site from
the District. This action would establish District regulatory control over
Acme Fill and accomplish the District's first objective. Term of permit,
fees for permit, rules and regulations for operation of disposal site, re-
quirements for submission of operational and financial reports and regula-
tory control of dumping fees are all negotiable and,at the moment, of second-
ary importance.
b. Requires all collection agencies, including shareholders
of disposal sites, who desire to utilize disposal sites within the District
to obtain a District permit. This action would basically accomplish the
District's second objective of preventing disposal of solid waste from com-
munities and counties beyond District boundaries. Regulations for control

of disposal site operator permits would specify that no collection agency is
authorized to utilize its site unless it has a District permit. Fees for
permits are negotiable but term of permit should be reviewed periodically
to preclude an "outside" collection agency from purchasing a "local" collection
agency and benefiting from its disposal site permit.
c. To protect the existing interest of private enterprise
language could be included in the ordinance that recognizes rights of current
shareholders of disposal sites operating within the District to continue to
use those sites even though the area in which they operate is outside of
District boundaries. However, to preclude the possibility that a "local"
collection agency may be purchased by an "outside" agency or it may expand
to an area totally outside of its logical disposal site area, language could
be included that stipulates amount of solid waste that may be dumped in District
disposal sites be based on actual operational reports for the previous three
year period (length of period is negotiable).
4. RECOMMENDATIONS: a. Direct Counsel for the District to incorporate the
concept described above into District ordinance or formulate a concept that
will accomplish the same objectives.
b. Action on a District ordinance should be initiated
as soon as practical. Other regulatory agencies and organizations have al-
ready initiated action in the field of solid waste management and with the
passage of Senatory Nejedly's bill on a solid waste management plan for the
state by 1974 which requires planning by the County, District action is most
important.

SUBJECT: Claim of $480.00 from Mr. Carlos A. Perez for
sewer damage
1. BACKGROUND: On Sunday, June 3, 1973, the District on -call crew
received a call to relieve a stoppage at 1401 Estudillo
Drive. Upon arrival, the crew found the 8" existing
line plugged 150' upstream from MH 81 toward MH 82.
The stoppage consisted of rags and grease.
The District crew cleaned and disinfected backyard
At 1401. There was no damage. In the meantime the
people at 1425 Estudillo Street had discovered that
their basement had been flooded because of the
stoppage. The crew pumped the sewage water out,
cleaned and disinfected throughout.

I investigated the damage and I feel that all
items were reasonable with the exception of the
televisions which seem to be exaggerated.
Since our main line was plugged I feel that a
payment of $300.00 would be fair for the incon-
venience and hardship that it has caused. This
was an accident, not an act of negligence on our
part.

MEMORANDUM TO: Honorable Board of Directors

SUBJECT: Outfall Study
The Regional Water Quality Control Board, under terms of the monitoring
requirements, required the performance of a minimum initial dilution study
of the Sanitary District Outfall.
The Board authorized $2,900 for the performance of this study by
E.Q.A. Inc. The initial study of December 6, 1971, indicated the need
for an expanded study, using hard hat divers, which was carried out
December 22, 1971.
The total expenditures for the two studies was $4,941.76. It is
requested that $2,041.76 be authorized from Sewer Construction funds to
cover the cost of this additional work.

In our original investigation of Mr. Perez' claim, we considered the
three (3) television sets to be partially or totally inoperative. This is
usually the case where television sets are concerned. We considered
Mr. Perez' evaluation to be too high ($330.00).
We have since discovered that Mr. Perez and a friend have a television
repair service; that the sets were operative with the exception of the
Emerson ($40.00), and that his estimate of value is realistic.
In light of the new facts, we are recommending a settlement of $440.00.
