Bailey General Manager ISSUE On July 2, 2024, four (4) sealed bids were received and opened for the construction of the POB Parking Lot Improvements, District Project 100067 (Project). The Board of Directors (Board) must award the contract or reject bids within 50 days of the bid opening. Authorization is also required for the General Manager to execute a Construction Contract in an amount over $200,000. BACKGROUND The POB parking lot paving and security cameras have been in use for decades and have reached the end of their useful life. As a result, this project will replace the asphalt paving and sections of concrete sidewalks near or within the parking lot area. I mprovements to the site lighting and security gates along with upgrades to the security equipment and cameras are included in the scope of work for the project. All security related items are in compliance with the recommendations provided by Central San's security July 25, 2024 Special Board Meeting Agenda Packet - Page 54 of 188 Page 2 of 6 consultant, Guidepost Solutions. Other improvements under the project include the security badging system for employee access, new camera locations and related information technology modifications, adding more parking spaces in the POB lot, and expand the laboratory parking area. I n total, twenty-one (21) additional parking spaces will result from the project. These new spaces are needed to accommodate employee parking as new security measures have been implemented to limit personal parking within the treatment plant. The new parking spaces are also needed for large events held at the Multipurpose room. The POB parking lot and the adjacent Laboratory areas are known to have contaminated soil. Therefore, removal and disposal of hazardous materials has been specified and required in the project and construction contract. The project is located at the Martinez campus outside the treatment plant, as shown in Attachment 1. Central San prepared the plans and specifications for the project. The Engineer's Estimate for construction is $750,000. This project was advertised on June 12 and June 17, 2024. Bids ranging from $854,200 to $1,090,000 were received and publicly opened on July 2, 2024. The Capital Projects Division conducted a technical and commercial review of the bids and determined that Cato's General Engineering, I nc. (Cato) is the lowest responsive and responsible bidder. Cato is a new contractor at Central San. References provided for Cato's General Engineering were contacted, and staff received satisfactory feedback. A summary of bids received is shown in Attachment 2. As of January of this year, the California Air Resource Board (CARB) has required verification of contractors performing public works projects to include a Certificate of Reported Compliance for the I n- Use Off -Road Diesel -Fueled Fleets Program, if applicable, prior to award. The two lowest bidders had minor discrepancies related to the CARB submittal requirements; however, staff confirmed that the bidders are properly registered. Cato's minor discrepancy related to the CARB requirement is immaterial to the bid and the Board is waiving the discrepancy due to substantial compliance by the bidder and independent verification by staff. Central San will administer the construction contract and provide contract administration, office engineering, inspection, and submittal review. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA): Staff has concluded that this project is exempt from the California Environmental Quality Act (CEQA) under Central San's CEQA Guidelines Section because it involves minor alterations to existing public facilities involving no expansion of use. Approval of this project will establish the Board of Directors' independent finding that this project is exempt from CEQA. ALTERNATIVES/CONSIDERATIONS Reject all bids, which is not recommended due to the needed infrastructure replacement and improved security measures for the area. This project includes enhanced security improvements reviewed and approved by Risk Management. FINANCIAL IMPACTS The total estimated project cost is $1,347,000, which includes planning, design, consultant, construction contract, contingency, and staff costs as detailed in Attachment 3. This project is being funded by two budgets included in the Fiscal Year 2024-25 Budget. These budgets are on page 300, Security Improvements District Project (DP) No. 100033, and page 305, POD Parking Lot Improvements DP No. 100067. Combined, the total estimated budget to date is $1,350,000. There is adequate funding this fiscal year for the project. RECOMMENDED BOARD ACTION Award a construction contract in the amount of $854,200 to Cato's General Engineering, Inc., the lowest responsive and responsible bidder for the Plant Operations Building (POB) Parking Lot Improvements, District Project 100067; authorize the General Manager to execute the project contract documents subject to submittal requirements; and find the Project exempt from the California Environmental Quality Act (CEQA) Strategic Plan re -In GOAL FIVE: Safety and Security Strategy 1 - Reduce and eliminate risks of injury or illness, Strategy 2 - Protect personnel and assets from threats and emergencies GOAL SIX: Infrastructure Reliability Strategy 2 - Execute long-term capital renewal and replacement program ATTACHMENTS: 1.
