BAILEY, GENERAL MANAGER ISSUE The Board of Directors (Board) authorization is required for the General Manager to execute amendments to professional engineering agreements in an amount greater than $100,000 for agreements with an original amount less than $2,000,000, in compliance with Board Policy 37, item 9b. BACKGROUND On September 7, 2023, the Board authorized the General Manager to execute a professional engineering agreement in an amount not to exceed $1,100,000 as related to District Project (DP) 100050, A -Line Sewer Relocation for CCTA. This effort is required by Contra Costa Transportation Authority (CCTA) to accommodate their final phase of the improvements to the State Route 4/ Interstate 680 interchange and will be reimbursed by CCTA, as required by California Streets and Highway Code Section 702. Utility Agreement No. 633 between CCTA and Central San was executed on May 17, 2023 with an estimated reimbursement amount of $1,907,032. This amendment to the professional engineering agreement with Carollo Engineers will extend the design of the relocation to the Treatment Plant's Influent Structure to obtain adequate clearance under Grayson Creek where the low -flow channel has eroded below the flood control channel's design in 1960. When the July 15, 2024 Special EOPS Committee Meeting Agenda Packet - Page 74 of 85 Page 2 of 4 A -Line Relief I nterceptor was installed in the early 1990s, it had to clear the eroded low -flow channel which required lowering the invert elevation of the headworks intake. The relocation of the A -Line will take advantage of this lower invert. This will extend the length of relocation/replacement from 2,000 LF to approximately 3,500 LF and ensure that Central San is ensure that the system remains self flushing under gravity flows. After an initial investigation to verify this concept, Carollo Engineers prepared a scope and budget revision which would increase the total agreement amount from $1,100,000 to $1,880,000. While this revised consulting budget is within the Utility Agreement amount, there will also be internal staff time for project management and coordination, so Central San will work with CCTA to confirm if they wish to execute an amendment now or utilize the Utility Agreement terms, which allows for reimbursement of costs in excess of the previously agreed upon amount in the final reimbursement claim package. California Environmental Quality Act (CEQA) At its meeting on June 15, 2023, the Board found this project to be exempt from CEQA. ALTERNATIVES/CONSIDERATIONS The Board may decline authorization of the amendment. This is not recommended as the amendment is necessary to provide a comprehensive design to ensure the relocation provides comparable operation; meaning, the relocation has to extend from the upper reach on Berry Drive all the way to the Treatment Plant's Influent Structure to obtain adequate clearance under Grayson Creek to ensure that the system remains self flushing under gravity flows. FINANCIAL IMPACTS While this project is included in the FY 2024-25 Budget on page 244, there will be no net impact to the Capital I mprovement Budget (CI B) or 10-Year Capital I mprovement Plan (Cl P) since the costs will be reimbursed by CCTA as outlined in the Utility Relocation Agreement. COMMITTEE RECOMMENDATION The Engineering and Operations Committee reviewed this matter at its special meeting on July 15, 2024, and recommended RECOMMENDED BOARD ACTION Staff recommends the Board authorize the General Manager to execute an amendment to the professional engineering agreement with Carollo Engineers, I nc. in the amount of $780,000 for an amended amount not to exceed $1,880,000 for design of the A -Line Sewer Relocation for Contra Costa Transportation Authority (CCTA), District Project 100050.
