ISSUE: On May 19, 2010 fourteen sealed bids were received and opened for the
construction of the Wet Weather Bypass Improvements, District Project 7241. The
Board of Directors must award the contract or reject bids within 50 days of the bid
opening.
RECOMMENDATION: Find that the project has complied with the California
Environmental Quality Act (CEQA), authorize the General Manager to award a
construction contract to Siteworks Construction, Inc. subject to receipt of the acceptable
and appropriate permit from the Sacramento District of the U.S. Army Corps of
Engineers, by 5:00 p.m. June 30, 2010, that provides approval for the proposed
encroachments and construction activities at Walnut Creek; authorize the General
Manager to execute the Contract Documents subject to favorable review of insurance
certificates, bond submittals, appropriate license(s), and any other required submittals
(SUBMITTALS); and authorize the General Manager to execute an amendment to the

Professional Engineering Services Agreement with Dodson Psomas. If the permit is not
received by 5:00 p.m. June 30, 2010, the Board rejects all bids, and authorizes the
General Manager to take all actions necessary to inform bidders of the rejection. The
rejection is automatic and self-executing if the permit is not received by 5:00 p.m., June
30, 2010.
FINANCIAL IMPACTS: Approximately $2,477,000, including design, bid price,
contingency, and construction management.
ALTERNATIVES/CONSIDERATIONS: Authorize the General Manager to reject all
bids now. This is not recommended.
BACKGROUND: The weUdry weather bypass project focuses on storage and
discharge of flows during peak wet weather events and during inspection/maintenance
of the outfall. The existing bypass point located in Basin C has insufficient capacity
during dry-weather flows, which results in flooding of properties owned by others. This
situation is significantly worse during wet-weather events. See Attachment 1 for the
location of the existing bypass point.
The Wet Weather Bypass Improvements Project is being constructed in two phases.
The first phase of this project involved placing a preload fill to consolidate the soft,
organic clay soils that underlie the site of the new bypass structure. The preload
construction work was completed and accepted by the Board on November 6, 2008.
The second phase of the project will provide necessary improvements to the
emergency wet weather discharge system, such as widening of existing bypass
channels, constructing the gravity overflow structure, constructing the box culvert to
discharge directly to Walnut Creek and installing riprap in Walnut Creek Channel.
Attachment 1 shows the location of this project work.
This project required permits from several regulatory agencies. All permits and
approvals, except for the permit from Sacramento District of the U.S. Army Corps of
Engineers, have been received. The U.S. Army Corps of Engineers permit is required

for the work within the Walnut Creek channel. The Contract Documents and permit
from Department of Fish and Game require the Contractor to finish work within the
creek by October 1,.2010. If the permit from the Sacramento District of the U.S. Army
Corps of Engineers is not received by June 30, 2010, the Contractor will not be able to
start work in the Walnut Creek channel in time to complete the work within the creek by
October 1, 2010, as required by Contract Documents and encroachment permit from
the Department of Fish and Game. Therefore, if an acceptable permit from the
Sacramento District of the U.S. Army Corps of Engineers is not received by the time
and date indicated the project should not be awarded.- Awarding the project without the
permit is not an option since it could expose the District to significant financial impacts if
the U.S. Army Corps of Engineers changes the permit conditions, doesn't issue the
permit at all, or issues the permit too late in the construction season.
Psomas and District staff, with the assistance of AMEC Geomatrix, Inc., prepared the
plans and specifications for the project. The Engineer's estimate for construction of the
Wet Weather Bypass Improvements, District Project 7241 was $2,700,000. This
project was advertised on February 19 and 24, 2010. Fourteen sealed bids ranging
from $1,856,203 to $2,560,525 were received and publicly opened on May 19, 2010. A
summary of bids received is shown in Attachment 2.
On May 25, 2010, the second low bidder, Gordon N. Ball, Inc., submitted a timely bid
protest claiming the bid submitted by Siteworks Construction, Inc. included electrical
work valued at more the'/z of 1°/0 of the bid amount and the bid should have included
the name of an electrical subcontractor who will perform the work. On June 7, 2010,
Gordon N. Ball, Inc. withdrew its bid protest, after learning Siteworks Construction, Inc.
would self-perform the work, as allowed by law.
The Engineering Department conducted a technical and commercial review of the bids
and determined that Siteworks Construction, Inc. is the lowest responsive bidder with a
bid amount of $1,856,203.

The District will perform construction management and will provide contract
administration, inspection, survey, office engineering, and submittal review. However,
staff recommends retaining Psomas to provide support services during construction for
this project because they have expertise in the design aspects of the project. The
construction support services include reviewing shop drawings and submittals,
responding to design questions, performing site visits to verify compliance with the
design intent, and other related activities. A construction support services agreement
amendment with a cost ceiling of $30,000 has been negotiated with Psomas. This will
bring the total professional engineering services agreement with Psomas to $175,000.
The funds required to complete this project, as shown in Attachment 3, are $2,477,000.
The total cost of Wet Weather Bypass Improvements, District Project 7241, is
anticipated to be $3,320,000.
This project is included in the fiscal year 2009-2010 Capital Improvement Budget (CIB)
on pages TP-68 to TP-69. Staff has conducted acash-flow analysis of the Treatment
Plant Program budget and concluded that adequate funds are available for this project.
The environmental effects of this project were addressed in the Wet Weather Bypass
Improvement Project Mitigated Negative Declaration approved by the Board of
Directors on October 16, 2008. Subsequently, a Notice of Determination was filed in
compliance with the California Environmental Quality Act (CEQA).
RECOMMENDED BOARD ACTION: Staff recommends the following:
1. Find that the project has complied with CEQA,
2. Authorize the General Manager to award a construction contract in the amount of
$1,856,203 for the construction of the Wet Weather Bypass Improvement
Project, District Project 7241, to Siteworks Construction, Inc., the lowest
responsive bidder, subject to receipt of the acceptable and appropriate permit
from the Sacramento District of the U.S. Army Corps of Engineers, by 5:00 p.m.
