ISSUE: A resolution of the Board of Directors passed by four affirmative votes is
needed to place charges on the Contra Costa County tax roll.
RECOMMENDATION: Adopt a resolution directing that the 2010-11 Capacity Use
Charges, the 2010-11 assessments for the Contractual Assessment Districts, and the
2010-11 assessments for the Alhambra Valley Assessment Districts be collected on the
Contra Costa County tax roll.
FINANCIAL IMPACTS: This action would provide for collection of approximately
$135,000 in 2010-11 charges from customers participating in the CCCSD's Capacity
Use Program; approximately $292,000 in 2010-11 assessments from properties that
formed Contractual Assessment Districts; and $193,000 in 2010-11 assessments from
properties that formed Alhambra Valley Assessment Districts.
ALTERNATIVES/CONSIDERATIONS: Not applicable.
BACKGROUND: Certain commercial tenants and commercial property owners have
entered into written agreements to participate in CCCSD's Capacity Use Program for
payment of Capacity Fees over afifteen-year period. These businesses are referenced
in Exhibit A attached.

Property owners who have formed Contractual Assessment Districts have agreed to
pay for sewer improvements over aten-year period. These properties are referenced in
Exhibit B attached.
Property owners who have formed Alhambra Valley Assessment Districts have agreed
to pay for sewer improvements over afifteen-year period. These properties are
referenced in Exhibit C attached.
Payments are to be collected by placing assessments on each property owner's tax bill.
A resolution of the Board is needed to place Capacity Use Charges, assessments for
Contractual Assessment Districts, and assessments for Alhambra Valley Assessment
Districts on the Contra Costa County tax roll.
RECOMMENDED BOARD ACTION: Adopt a resolution directing that the 2010-11
Capacity Use Charges, the 2010-11 assessments for Contractual Assessment Districts,
and the 2010-11 assessments for Alhambra Valley Assessment Districts be collected
on the Contra Costa County tax roll.

A RESOLUTION DIRECTING THAT
THE 2010-11 CAPACITY USE PROGRAM CHARGES,
THE 2010-11 ASSESSMENTS FOR CONTRACTUAL ASSESSMENT DISTRICTS,
AND THE 2010-11 ASSESSMENTS FOR ALHAMBRA VALLEY ASSESSMENT
DISTRICTS BE COLLECTED
ON THE CONTRA COSTA COUNTY TAX ROLL
WHEREAS, the Central Contra Costa Sanitary District (CCCSD) has entered into
written agreements with certain commercial tenants and commercial property owners to
participate in CCCSD's Capacity Use Program for payment of Capacity Fees; and
WHEREAS, the commercial property owners have elected to pay the Capacity Use
Program charges in annual installments over a period of fifteen years; and
WHEREAS, CCCSD has entered into written agreements with certain property owners
who have formed Contractual Assessment Districts to pay for sewer improvements over
a ten-year period; and
WHEREAS, CCCSD has entered into written agreements with certain property owners
who have formed Alhambra Valley Assessment Districts to pay for sewer
improvements over afifteen-year period; and
WHEREAS, the CCCSD Code provides that CCCSD may elect to collect current
charges on the tax roll as provided by Section 5470 and following, of the California
Health and Safety Code; and
WHEREAS, it is considered economical and efficient to collect the Capacity Use
Program charges for the 2010-1 1 fiscal year on the Contra Costa County tax roll; and
WHEREAS, it is considered economical and efficient to collect the assessments for the
Contractual Assessment Districts for the 2010-11 fiscal year on the Contra Costa
County tax roll; and
WHEREAS, it is considered economical and efficient to collect the assessments for the
Alhambra Valley Assessment Districts for the 2010-11 fiscal year on the Contra Costa
County tax roll;

NOW, THEREFORE, be it resolved by the Board of Directors of the CCCSD that the
2010-11 Capacity Use Program charges for the commercial tenants and commercial
property owners as listed in Exhibit "A", the 2010-11 assessments for Contractual
Assessment Districts as listed in Exhibit "B", and the 2010-11 assessments for
Alhambra Valley Assessment Districts as listed in Exhibit "C" are to be collected on the
Contra Costa County Tax Roll, and by this reference Exhibits "A", "B" and "C" are made
a part hereof.
Passed and adopted this 3`d day of June, 2010 by the CCCSD Board of Directors by the
