1) Approval and adoption of the FY 2010-2011 Operations and Maintenance
(O&M) Budget, Debt Service Fund Budget and Self-Insurance Fund
Budget, and establishment of the FY 2010-2011 Sewer Service Charge
rates; and
2) Collectibn of the FY 2010-2011 Sewer Service Charges on the County tax
roll.
Call for staff report on both public hearings.
2. Open first public hearing and call for comments.
3. Close public hearing.
4. Board deliberation, and:
a. Vote to approve and adopt the FY 2010-2011 O&M Budget, Debt Service
Fund Budget and Self-Insurance Fund Budget, incorporating Sewer
.Service Charge as determined by ordinance to be considered separately;
and
b. Vote to set the Sewer Service Charge for FY 2010-2011, to be
incorporated in the FY 2010-2011 budget:
1) Adopt an uncodified ordinance increasing the Sewer Service
Charge by $16 for a total Sewer Service Charge of $327 per RUE
(staff recommendation.), or
2) Adopt an uncodified ordinance setting the Sewer Service Charge
increase between $0-$16 for a total Sewer Service Charge

3) Take no action which continues the Sewer Service Charge at the

ISSUE: The District Code and State law require public hearings for the establishment
of the Sewer Service Charge rates for FY 2010-2011 and on placing the FY 2010-2011
.Sewer Service Charges on the County tax roll for collection. An uncodified ordinance
passed by four affirmative votes is needed to increase the Sewer Service Charge. A
resolution passed by four affirmative votes is needed to place the charges on the
Contra Costa County tax roll. Although not required by law, the District will hold a public
hearing to receive public comment on the FY 2010-2011 Operations and Maintenance
Budget, Debt Service Fund Budget and the Self-Insurance Fund Budget.
RECOMMENDATION: Conduct two separate Public Hearings and upon their
respective conclusions, take the following actions, if considered appropriate:
Approve and adopt the FY 2010-2011 Operations and Maintenance Budget
(O&M), Debt Service Fund Budget and Self-Insurance Fund Budget
Approve an uncodified ordinance increasing the Sewer Service Charge by $16
for a total Sewer Service Charge of $327 per residential unit effective beginning
FY 2010-2011.
Approve a resolution authorizing collection of the 2010-2011 Sewer Service
Charges on the County tax roll.

FINANCIAL IMPACTS: The draft FY 2010-2011 O&M Budget is based on a $0 rate,
increase in the Sewer Service Charge for a total of $311 per residential unit equivalent,
allocating $300 to Operations and Maintenance and $11 to the Sewer Construction
Fund. At the January Financial Workshop, staff recommended a $16 Sewer Service
Charge increase. In April, the Board approved sending a Proposition 218 Notice to
property owners advising them of a possible Sewer Service Charge increase of up to
$16 for a total Sewer Service Charge of $327. If the Board approves an increase in the
Sewer Service Charge, staff recommends that it be allocated to the Sewer Construction
Fund to support the capital program.
Also, a $4.3 million allocation towards the unfunded liability associated with GASB 45
post retirement benefits is included in the draft 2010-2011 budget. This allocation will
remain unencumbered until action by the Board. The proposed $16 Sewer Service
Charge increase would generate approximately $2.6 million in new revenue for fiscal
year 2010-2011 with the recommendation that it be allocated to the Sewer Construction
Fund. From the total $327 Sewer Service Charge, $300 would be allocated to O&M
and $27 to the Sewer Construction Fund. This allocation was set with the goal of
restoring approximately a 10% O&M prudent reserve. The proposed budget would
result in a decrease to O&M reserves at fiscal year end of $640,000 for a projected
O&M reserve balance at June 30, 2011, of $5.5 million.
ALTERNATIVES/CONSIDERATIONS: The Board could decide not to increase the
Sewer Service Charge for FY 2010-2011, keeping the Sewer Service Charge at the
current $311, or choose another amount of increase up to $16 which was included in
the Proposition 218 Notice sent to customers in April.
Effective with the 1982-1983 fiscal year, Contra Costa County imposed a fee for
collecting the Sewer Service Charge on the tax roll. The County fee, which
approximates $100,000 annually, is much more economical than the alternative of
direct billing by the District.

BACKGROUND: The FY 2010-2011 Operations and Maintenance Budget was -
submitted for review at the May 20, 2010, Board Meeting. A detailed presentation was
made to the Board at that meeting and a copy of the overheads used is attached (see
Attachment 1).
A Proposition 218 notice, which requires the District to provide at least a 45 day notice
to all rate paying property owners for a Sewer Service Charge rate increase, was sent
in April 2010. Approximately 105,200 Proposition 218 notices were mailed. As of May
28, 2010, a total of 149 telephone calls, a-mails and letters have been received (see
Attachment 2). This is less than .1 % of total notices mailed.
Legal notices were published in the Contra Costa Times and the San Ramon Valley
Times for the June 3, 2010, Public Hearing to receive public comment on the FY 2010-
2011 Operations and Maintenance Budget, Debt Service Fund Budget and the Self-
Insurance Fund Budget, for the establishment of the Sewer Service Charge rate for FY
2010-2011, and on collection of the 2010-2011 Sewer Service Charges on the County
tax roll.
It is recommended that two separate hearings be held to consider the matters
described.
Hearing to receive public comment on the FY 2010-2011 Operations and
Maintenance (O&M) Budget, Debt Service Fund Budget and Self-Insurance Fund
Budget and for the establishment of the Sewer Service Charge rate up to $327 for
FY 2010-2011:
The FY 2010-2011 O&M Budget and Debt Service Fund Budget were submitted
to the Board of Directors for initial review at the May 20, 2009, Board Meeting
and the Self-Insurance Fund Budget was approved by the Board at the April 1,
2010, Board Meeting. All three are scheduled for approval and adoption at the
June 3, 2010, Board Meeting. Upon approval of the three budgets and
determination of adequate levels of reserves, the Board must establish the 2010-
2011 Sewer Service Charge rates.

Hearing to consider collection of the FY 2010-2011 Sewer Service Charges on the
County tax roll:
The law requires that a public hearing be held each year before the Sewer
Service Charge can be placed on the County tax roll. The Sewer Service
Charge has been collected on the County tax roll since inception of the service
charge in 1976. Collection on the tax roll provides the most economical and
efficient means for the District to collect the charges for approximately 105 000
accounts.
RECOMMENDED BOARD ACTION: Conduct two separate public hearings and upon
their respective conclusions, take the following actions, if considered appropriate:
• Approve and adopt the FY 2010-2011 Operations and Maintenance Budget,
Debt Service Fund Budget and Self-Insurance Fund Budget (requires 3 votes)
and
• Approve an uncodified ordinance increasing the Sewer Service Charge by $16

ORDINANCE NO.
AN UNCODIFIED ORDINANCE OF THE
CENTRAL CONTRA COSTA SANITARY DISTRICT
ADOPTING A SCHEDULE OF SEWER SERVICE CHARGE RATES
IN ACCORDANCE WITH DISTRICT CODE CHAPTER 6.24.030
WHEREAS, the District has previously developed and instituted a Sewer Service
Charge Program to finance the services and facilities furnished by the District, and
WHEREAS, it is reasonable and necessary that all users of the District's wastewater
and household hazardous waste collection, treatment, recycling, reuse and disposal
services and facilities, including-those temporary users served under Special Discharge
Permits, contribute their appropriate portion of the funding for such District services and
facilities; and
WHEREAS, the Board of Directors of the District has reviewed the current Schedule of
Sewer Service Charge Rates and has determined that the annual residential sewer
service charge rate should be increased by $16.00 per living unit to $327.00 per living
unit and that non-residential sewer service charge rates be increased by proportionally
similar amounts as the residential sewer service charge rate; and
WHEREAS, Chapter 6.24.030 of the District Code provides the enabling authority for
the District to implement the proposed uncodified Schedule of Sewer Service Charge
Rates; and -
WHEREAS, a properly noticed public hearing to receive comments and protests and to
consider the proposed uncodified Schedule of Sewer Service Charge Rates was held
on June 3, 2010; and
WHEREAS, in adopting this Ordinance, the Board of Directors finds that:
Written notices of the proposed increase in sewer service charge rates were
sent by first class U.S. mail to every owner of property connected in the
District at least 45 days prior to the Public Hearing on the proposed increase
conducted on June 3, 2010.
b. All written protests against the proposed increase in the sewer service charge
rates, including those provided in person, by facsimile, email and U.S. mail,
were considered and tallied at the Public Hearing conducted on June 3, 2010,
and the District was not presented with protests by a majority of the owners of
the identified parcels affected by this change.

c. The amount of the charge imposed does not exceed the proportional cost of
the service attributable to the properties receiving service and the charge is
only imposed on those properties actually receiving service or for those which
service is immediately available.
d. This action is categorically exempt from the California Environmental
Quality Act (CEQA) pursuant to Section 15273 (a) (1-4) of the District CEQA
Guidelines.
NOW, THEREFORE, the Board of Directors of the District does ordain as follows:
Section 1 (To be Uncodifie~
The "Schedule of Sewer Service Charge Rates" as set forth in full in Exhibit "A" to this
Ordinance, which exhibit is incorporated in full herein by this reference, is hereby
adopted in uncodified form pursuant to the provisions of District Code Section 6.24.030.
As of the effective date of this Ordinance, Sewer Service Charges shall be charged at
such rates and for such categories of users as set forth in said Schedule, and shall
remain in effect until amended or replaced by ordinance.
Section 2
All ordinances, parts of ordinances and any provision of Resolution 2008-063 in conflict
with the provisions of this ordinance are repealed. The provisions of this ordinance,
insofar as they are substantially the same as existing provisions relating to the same
subject matter shall be construed as restatements and continuations thereof and not as
new enactments. To the extent this ordinance or any portion or section of this ordinance
is determined invalid or unconstitutional, such portions of Resolution 2008-063 shall
remain in effect and such rates and charges due thereunder for any categories of users
shall remain due and payable as if those portions of Resolution 2008-063 had not been
repealed.
With respect, however, to violations, rights accrued, liabilities accrued, or appeals taken,
prior to the effective date of this Ordinance, under any chapter, ordinance, or part of an
ordinance, such chapter, ordinance or part of an ordinance shall be deemed to remain
in full force for the purpose of sustaining any proper suit, action, or other proceedings,
with respect to any such violation, right, liability or appeal.
Section 3
This Ordinance shall be a general regulation of the District and shall be published once
in the Contra Costa Times, and the San Ramon Valley Times newspapers of general
circulation within the District, and shall be effective on July 1, 2010. This ordinance
shall be kept on file with the Secretary of the District.

A RESOLUTION DIRECTING THAT THE FY 2010-2011
• SEWER SERVICE CHARGES BE
COLLECTED ON THE COUNTY TAX ROLL
WHEREAS, the District has previously developed and instituted a Sewer Service
Charge Program for services and facilities furnished by the District to finance yearly
Operation and Maintenance of the District; and
WHEREAS, the Sewer Service Charge is collected through a direct charge to the users:
and
WHEREAS, the District Code provides that the District may elect to collect current and
delinquent charges on the tax rolls as provided by Sections 5470 and following of the
Health & Safety Code; and
WHEREAS, it is considered to be economically and efficient to continue the existing
practice and collect the Sewer Service Charges for the 2010-2011 fiscal year on the
county tax roll;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the Central
Contra Costa Sanitary District, that the FY 2010-2011 Sewer Service Charges are to be
collected on the County of Contra Costa tax roll.

As I understand your notice, the California State Assembly decided to borrow 8% of the property taxes
collected by CCCSD because the State cannot raise property taxes in excess of that allowed by
Proposition 13.
The District therefore, is taking the position of a tax collector for the state of California by imposing a tax
disguised as a service rate increase that I believe to be in violation of Proposition 218, "the right to vote
on taxes Act" passed by H1TA in 1996.
In these hard economic times the private sector and the public sector have taken drastic measures to
adjust to the shortage of operating revenues by going into staff reduction mode. In fact my employer
recently, laid me off and reduced the work week for the rest of the p"ersonnel to prevent additional
layoffs. The DMV has eliminated work every other Friday to prevent lay-offs etc.; therefore, I don't see
why CCCSD couldn't take similar reduction measures.

Your proposal is outrageous. It is presumptive and supports
a dangerous, slippery slope for.everyone. The State Assembly
has passed on, ie "kicked- the- can; down the road and you
as well as everyone should be making the loudest of protests.
The State must decrease and balance its budget just as I do.
It should not be allowed to shrug off its responsibilities,
deferring them to others.
It is not acceptable to "allow" (!?!) the State•.,to••"borrow
80 of property taxes." I do not believe. it would'`ever be repaid,
just as the sewer tax increase would Heuer revert.
In addition, this proposal creates a very bad preseddnt;,;,,CJhat
next? If this preposterous usurpation is allowed to persist'
unrefuted, i3x will only lead to more wrongful seizures.
When is it going to become clear to all cities„ counties, State
and Federal governments that the message from paying peo~Le
is NO MORE TAXES (or increases)?

This is to serve notice to The Board of Directors of The Central Contra
Costa Sanitary District that simply throwing money at a problem,
shortfall, condition, or incompetence, is not the best or only solution, as
they seem to think it is! I would ask The Board to think again.
I would ask The Board to consider other solutions than asking for more
money, or spending more money to solve problems they face.
Our society is fixated on a course to spend, spend, and spend to fix
any problem. Our miserable education system is a good example.
A lot of folks, probably most folks think that if we pay teachers more
money, it will make them better teachers, which is simply not the case
Yet that's what we do. We give the schools more and more money to
perpetuate their laziness, greed and incompetence. The result:
A dumbed-down society that can't read nor write, never mind think.
Unfortunately, we are doing the same thing with you folks.
So, I challenge the Board to become creative in problem solving
which is not a process for lazy people, or people without common
sense or an education. Problem solving is not always easy nor the
solution always simple, but it is possible... and it's often possible
without throwing

Please be advised that the new sewer rate increases which you will discuss at
the District's Public Hearing on June 3, 2010 is an affront to the vast
majority of people who are suffering financial setbacks during this period of
economic downturn.
While many employees of private companies have lost their jobs, many
others have taken pay cuts, many government employees have had to suffer
.forced furloughs, and Social Security recipients are not being given a cost of
living increase, the District apparently does not intend to let the recession
decease its spending. Instead, the District proposes an across the board rate
of 5% for itself in 2010.
How disgusting and callous! I don't expect that the District will change its
position, but I will do my best in coming years to place a measure on the
ballot, similar to Proposition 13 which limited property tax increases, to
limit the amount of the annual sewer rate increase which the Central Contra
Costa Sanitary District can make. In addition, the ballot measure will
specify that when there is negative economic growth, the District shall be
prohibited from raising its water rates at all.
You people are completely out of touch with reality and it appears that you
will do what you want until the people take charge and restrict your
authority to squeeze more and more money from people living within the
Central Contra Costa Sanitary District.

Dear Sir or Madam:
Received your Notice of Proposed Increase in Annual Sewer Service Charge, and
although I understand your financial situation, I also have financial difficulties. I am
living on $ l 100 a month (Social Security) and can not keep supplementing every agency
needing additional funds. I have no one to go to for more money. If this proposed
increase goes through, I will have to cut back on my living expenses.
The first thing I will do is cancel the newspaper which I presently receive. So your
increase will have.a domino effect. You probably think $1.33 a month isn't that much
and everybody certainly can afford that. No, not true, as it isn't just the $1.33 which you
will charge, but the schools, PG& E, EBMUD and the phone as well as groceries., just to
name a few are also coming to the citizens for more money. I know no one wants to cut
back on salaries and benefits, but I have to, and why am I different from CCCSD
employees and management, AND I personally feel, the EPA is causing everybody a lot
of problems.
I appreciate your attention to my concerns.

This letter is in response to your recent mailing: "Notice of
Proposed Increase in Annual Sewer Service Charge". I own residential and
commercial property in San Ramon. The proposed increases will involve
both of my properties.
I am adamantly opposed to raising these charges. In view of current
economic conditions, the CCCSD should be making every effort to maintain
or lower their current rate structure. Most private businesses and many
government agencies have made difficult reductions in their operating
budgets. The management of CCCSD should do the same!
As a former resident of San Leandro, I am familiar with the rate
structure of the Oro Loma Sanitary District. The OLSD currently charges
residential rate payers: $178 per year. CCCSD charges are already
substantially higher than the rates in the OLSD. Your proposed increase will
widen this mazked disparity in chazges. Clearly, the OLSD has managed to
control their expenses. I urge you to curb expenses at CCCSD, reconsider
these increases, and strive to maintain the current rate structure.
I regret that I will be out of town during your public hearing on June
3. Please accept this written statement in opposition to the proposed rate
increases.

NOTICE OF PROPOSED INCREASE IN ANNUAL SEWER SERVICE CHARGE
Dear Property Owner:
District
Central Contra Costa Sanitary District (CCCSD) provides sanitary sewer, household hazardous waste
collection, and recycled water services in the central county area. Sanitary sewer service includes the
operation, maintenance, and construction of public sewer pipelines, pumping stations, our wastewater
treatment plant, and the pipeline that discharges clean, treated, disinfected water to Suisun Bay.
To pay for these services, CCCSD collects an annual Sewer Service Charge from each property connected to
the sewer system. The current residential rate is $311 per year, billed as a line item labeled "CCCSD SEWER
CHG" on the property tax bill you receive from Contra Costa County. (About 300 properties, particularly
government and non-profit facilities are billed directly). CCCSD also receives approximately $73 of your
property tax for operating, maintaining, and renewing of facilities.
In July 2009, the California State Assembly passed a bill as part of the 2009-2010 State budget that allowed
the State to borrow 8% of the property taxes collected by counties, cities, and special districts. For CCCSD,
that 8% takeaway amounted to more than $960,000. That money is_not.expected to be repaid until at least
2012..CCCSD did. not.increase-its SewervService_Charge after-this akeaway: --~ ~ ~ ct~-~`
Given this significant loss, no Sewer Service Charge increase for FY 2009-2010, and the necessity to continue
meeting all our regulatory requirements, including our National Pollutant Discharge Elimination System
(NPDES) permit requirements; collection system improvements to prevenUreduce sewer overflows and new
overflow reduction regulations; pipeline and facility improvements; and other new increasingly stringent and
expensive environmental regulations, the CCCSD Board must consider an increase of the annual Sewer
Service Charge of up to $16 ($1.33 per month) for a total of up to $327 per year, effective July 1, 2010.
FOR RESIDENTIAL CUSTOMERS, whether single-family home, mobile home, townhouse, condominium,
apartment, or other multi-family home, this would be a maximum increase of just slightly more than 5% over
the present rate, up to $327 per year.
FOR NONRESIDENTIAL CUSTOMERS ONLY: The service charge rates are calculated for each customer
group based on the cost to provide service, considering both the quantity of sewage discharged and other
sewage characteristics affecting the cost for treatment. The service charge increases being considered for this
category are shown on the reverse side of this notice.
NOTICE IS HEREBY GIVEN, that the Board of Directors of the Central Contra Costa Sanitary District will hold
a PUBLIC HEARING on this matter in the CCCSD Board Rodm, 5019 Imhoff Place, Martinez, California, on
Thursday, June 3, 2010 at 2:00 p.m., at which time and place interested persons may appear and be heard.

With the economy still) floundering and unstable, with the growing number of citizens who are
long-term unemployed, why would you select this time to raise rates? Though not a large
increase by most standards, your Board of Directors needs to consider that the time is not right
for a large portion of the citizenry to absorb rate increases in any utility. Instead of rate
increases, why not look at salary cuts for the management employees in the Contra Costa
Sanitary District? Why not eliminate stipends for managers for cell phones, conferences, and
car allowances? For Board members, many of whom are employed in other jobs, why not cut
back on stipends and on benefit packages which often duplicate what they receive from their
private sector jobs? As a retiree on fixed income, I encourage the Board of Directors to look at
cost cutting measures prior to enacting another rate increase.

Dear CCCSD,
I received your April 16, 2010 re: proposed increased rates. I understand that the State has taken money
from your budget temporarily. However, I suspect that if you looked into your internal operations you
could find far more than 5% in savings.
As a long-time CCC resident, I have for years heard the boasts of CCCSD workers who drag out projects
for overtime, dramatically increasing their wages, while producing no additional value for the County or
the CCCSD. Moreover, I have heard stories of teams allowing members to sleep or nap while others
cover for them in the field or in the plant.
Increased supervision and accountability could dramatically reduce personnel costs.
Furthermore, since the State of California has only "borrowed" the money, it is imperative that any
increase have two mandatory conditions:
1) that the rate increase be temporary, matching the time the State borrows the money, and
2) that the money be repaid to CCCSD customers in the future, since CCCSD will eventually get that
portion of the budget back from the state.
As it is appears now, it looks like a permanent increase is proposed for a loss that is not only short-term,
but not really a loss at all -since it is essentially a loan.
If you want a loan from your customers, make sure the terms are in the proper form.

Dear Directors of the CCCSD,
Thank you for the notice explaining the proposed 5% increase in annual charges to
property owners, and giving us an opportunity to comment. I certainly can
sympathize with the precarious position in which the State of California has placed
you, the county, and other agencies. Apparently, the trend in California is
municipal cannibalization, and we're all in big trouble.
Although, on the one hand, I think the increase is justified and not exorbitant
on its surface, life as a California homeowner has taught me (and others) to be
skeptical about the context in which such things are couched. You likely will be on
the business end of that anger-stick at your scheduled hearing on June 3. It's
fairly clear that, following any repayment by the State to the county,' and
subsequent (or not) repayment to the CCCSD by the county, the higher property
tax charge for the CCCSD will continue. Some things never roll back.
It is not beyond reasonable thinking that our county/city coffers will continue to be
cannibalized by the State, that rates for all manner of services will rise year-after-
year, that the California economy eventually will normalize, that the State may
repay the counties/cities, and that service rates, like the one which you are
proposing, will not return to adjusted levels in 2012. By then, the CCCSD and
others will have found a bazillion, compelling reasons why it needs both the
repayment and the increased rate to support additional capital improvement
projects, salaries, facilities maintenance, addressing regulatory requirements,
whatever.
Californians should be used to poor management tactics by now, but w.e don't take
to them readily. If I were you (selling me the idea of a rate increase), I would
include a clearly written and enforceable statement from the county's Board of
Supervisors promising to reimburse the CCSD, if it is repaid by the State in 2012;
and another statement from the CCCSD on how, if reimbused by the county, that
money will be distributed back to taxpayers, and how rates will be rebalanced
following the "loan period" ending in 2012.
I also would encourage you to tell those of us, who you are about to tax, what you
have been doing to cut expenses during the current fiscal crisis. We know that

you had wonderful plans for your.budget prior to the State's appropriation
of county property taxes, and that your 5% charge increase proposal will not cover
fully-your temporary losses. At present, your notice makes it appear that you
didn't have to or will need to manage the remainder of the budget reduction.
You need to demonstrate a recognition that the world is different now... we're atl
pinching pennies, adjusting spending, re-ordering priorities. It may
not help taxpayers greet your proposal with glee, but such statements of
accountability should accompany each and every rate increase proposal coming
our way from county/city governments and public services. We're still in shock
over the revelations on county employee pensions.
This will not be the end of similar predicaments and proposals by other affected
agencies in the county, and I am conscious of the tough fiscal decisions faced by
the county. I'm also buckling my seatbelt and holding tightly to my wallet each
time that I open the mail.

This year I as a middle class home owner have been attacked on all fronts.
I have endured a pay cut.
I have endured a bonus cut.
I have endured a shares cut.
I have endured added hours at work for the above privilege.
I pay over 10K in property tax a year while my next door neighbor pays 2K thanks to the totally unreasonable
Prop 13.
Stop KILLING US FINANCIALLY!!
Property tax is not the answer.
You need to get I line with the rest of the world.
Cut your costs to make ends meet.
Just like we have to.

Our Fed Tax's are going up next year, our incomes and job are down.. blood out of a turnip going on in CA.
Water shut down in San Juaqin Valley.. so the farmers now there can't grow produce anymore.. Almonds,
Tomatoes.. all that Organic Produce Japan fights to buy from the USA.
Now we will likely import our "organic" Produce from China" Who practically owns the USA now.. Very Smart
People.
We may be living.in Walnut Creek, Ca but we will still continue fighting for our survival as home owners. Don't
worry.
Martinez is a lovely, Historical town where the "Martini" was first discovered. Many close friends of mine
enjoy living there.
Maybe that's where I should have purchased my first home :)

CCCSD operates under a fiscal year budget cycle beginning July 1 and ending June 30. Like many public
agencies, CCCSD has two primary budgets: one for Operations & Maintenance (O&M), and another for
Capital Improvements. The 2009-10 O&M Budget is $59.7 million. The planned 2009-10 Capital
Improvement expenditures are $40.1 million"
So the "takeaway' of $960,000 -call it $1 million - is just a 1.7% hit, NOT 5%, even using just the smaller
O&M number. More soundly, if we use the full budget of $100 Mil, the "takeaway" is only a 1% hit.
SO WHY ARE YOU TRYING TO RAISE FEES 5%?? If you were approaching this in an honest manner,
you'd be requesting a 1% increase for two years and then a rollback when you are repaid by the State.
The 5% request is outrageous, would last indefinitely into the future, and is an attempt to rip off customers
under a smokescreen of blaming the State.

Based on my understanding of the notice, we would like to make the following presumptions:
Since the increased charge appears to be a result of the State's borrowing a portion of property
taxes that otherwise would be going to Central Son; and Central San expects to be repaid by 2012
(or later); we would expect that, when the amount is repaid (with interest, presumably): 1) the
(proposed) residential increase will at that time be eliminated; and 2) residential customers will be
refunded the increased amounts we have paid in the interim (with interest, presumably).
Are our presumptions correct?

Based upon your recent letter, the proposed increase in annual sewer service charge is due to the State of
California "borrowing" approximately $960,000 from the CCCSD. According to the letter, that money is not

What does not appear to covered in your letter is what happens when the State of California repays this money
(with interest, I would expect). I would anticipate that my annual rate will be reduced by at least the same amount
that you proposed raising now. Failure to do so will amount to the theft of this money by the State of California
which should then result in prison time for those responsible. Please clarify this issue.

I do not understand your request to increase the Annual Sewer Service Charge to compensate the
CCCSD for a loan that you are making to the State of California, although a forced loan. The State of
California is BORROWING the money from you, therefore creating an asset on your balance sheet in
the form of a loan receivable from the State. However, you propose to replace the working capital that
you must use to fund the loan by revenue from your users. The State is obligated to repaid the loan
eventually but, by replacing the working capital with revenue, CCCSD has no obligation to repay the
revenue that you are taking from the users to fund the working capital used for the loan. Why don't you
get a working capital loan against the asset, being the loan to the State to fund the working capital
reduction.
Under your proposal, when the state repays the loan and you have collected the amount of the loan from
the users via revenue, your balance sheet will have additional cash in the amount of the loan than if you
had not had to make the loan to the State and could not use it as an excuse to increase the Annual Sewer
Service Charge because you are not required to repay the users for the loan that you are getting from
them in the form of increased revenue.
This is unfair and notjustified by the facts. Take the loan to the State to the bank and get a loan against
it to fund your working capital needs.

I just received a letter from Central Contra Costa Sanitary District about proposed increase in annual
sewer service charge. I decided to express my opinion reading this matter.
From this letter I have understood that the state borrows money from property taxes that will be paid off
at some point (the letter says that this will be repaid until at least 2012) and this is one of the main
reasons why the charge for the service will be increased. In my opinion the key here is borrowing.
Since the main purpose of the increase is borrowing by the state and money will be repaid, at the end
of the term I would like to get these money back with the same terms as these money were borrowed
from the property tax. We have some kind of domino effect of borrowing, I would like to see the same
effect at the end of the term; otherwise the state, Contra Costa county, and CCCSD put this problem on
our shoulders. That is my opinion.

We were required to hook up to the sewer system from a septic tank as a condition of obtaining a
building permit to add an additional master bedroom suite to our home in 1985. At that time, the annual
sewer service charge was $85. The current annual residental rate of $31 I. represents an average annual
increase over those 25 years of 5.33% which is well in excess of the annual rate of inflation as measured
by the CPI. Therefore, I strongly urge the CCCSD Board Not to increase the annual Sewer Charge
and in fact to reduce it effective 7/1/2010.

1. While $16 per year doesn't sound like much, it is on top of all of the increases in the cost of almost
everything. Whether it is EBMUD, PG&E, or whatever, Contra Costa County is becoming increasingly
unaffordable as a place to live. Eventually it will force us to leave.
2. I hope that you will join with tax payers to oppose the continual money grab of local funds by the
state government and support the initiative that is being proposed to prohibit it from happening in the
future -hands off our money, legislature.
3. Finally, aquestion -what happens when the legislature pays back the $960K "take away" as you call
it -will you credit our property tax bills accordingly or just pocket the money? Hopefully it will be the
former.

seem fair.
3. Has the new economic environment with fewer developments coming on line and higher
efficiency plumbing fixtures created a savings for the Sanitation District that is not being
considered in this rate increase?
One other question, separate from the rate increase, but of interest to me, is how the fee calculated? Is
it by water used or a flat rate?

I recently received the "Notice of Proposed Increase in Annual Sewer Service Charge" in the mail and
have the following comment for your consideration.
In the Notice is described the "significant" loss of the 8% takeaway by the State. The Notice states that
this takeaway is one of the reasons for the necessity of a rate increase.
It is important to point out that this takeaway was a one time event. Approving a permanent rate increase
to offset a temporary cost is neither appropriate nor fair to the ratepayers. Therefore, the portion of the
eventual rate increase that can be attributed to this takeaway should be for only a single year.
Also, the State must repay the municipalities with interest within three years. When the State repays the
takeaway, the District will be receiving surplus revenues, i.e., the full property tax apportionment plus the
takeaway repayment. When this happens, the repayment should be passed on to the ratepayers via a
temporary rate decrease. Since the ratepayers are being asked to supplant District revenues lost to the
takeaway, when the takeaway is repaid, it only makes sense that the repayment flow back to the
ratepayers who supplanted the lost takeaway revenues in the first place.

I'm in receipt of your notice of proposed increase in annual sewer service charge. From the information
therein this appears to be no more than a TAX levied by the state upon the people you provide service.
Tell me what stops the State Assembly from passing a similar bill this year as part of the 2010-2011
State budget that allowed the State to borrow 10% or 15% of the property taxes collected by CCCSD.
Would you then pass this cost on to the people you service? Have you conferred with representatives of
the cities and the county to determine if the State is planning to borrow 8% from them and whether they
are passing on the costs to their citizens?
What are the terms of this so called loan? Please advise as to the interest rate, length of contract, any
consideration provided by the State other than interest. Ycur statement "that money is not expected to be
repaid until at least 2012" is at best very vague.
How much money will you receive annually from the interest charges? How will this money be utilized
and how will it be accounted for to the people you provide service and plan to further charge? .
It would be greatly appreciated if you would provide the answers to the fore going questions so I would
have a better understanding as to how you operate your business. Thanking you in advance.

that all cities, counties, districts and public entities are struggling with California's Budget Balancing Act, I simply
cannot afford or support another increase passed down to the tax payers. Enough is enough. I think it's ironic
that the same state that touts such high environmental standards and places all these regulations on you, takes
away the funding to support such high regulations. Maybe its time you and the public push back on these
unsustainable regulations. I work for a large city in the Bay Area in a government job so I know how tough it has
been the past few years, however, we have made cuts, reduced our personnel costs, laid off employees, reduced
our payroll, taken furlough days and reduced services rather than pass more costs onto residents. I ask that you
consider doing the same. The bottom line is the state has not taken your funding it has "borrowed" it, so you will
get it back and you need to make adjustments in the meantime. If we are to pay this additional fee, will we be
getting a refund in 2012 when the CCCSD gets paid back from the state???? I kind of doubt it. The increased
rate will continue and costs will continue to sky rocket. I ask that you please consider other "affordable"
alternatives.

This is the wrong time for a rate increase.
Many of us our struggling financially in these difficult times, yet you ask for 5%: why does government believe it is
immune to cost constraints like all of us live under? What other business is raising prices today?
The State "take away" sounds temporary, why ask for a permanent rate increase?
I have always resented the extravagant benefit packages government, especially special district, employees
receive. What cuts have you made in that area? Why is it always easier to ask us for an increase than to ask
those who work for you to give a little? ff they are not happy with their pay and benefit packages, there is a line of
people who would gladly step into their jobs.
I am opposed to this increase. I realize, as is always the case with these special districts, our opinions count little.

PLEASE! NO FEE INCREASES in 2010!
We just received your notice requesting an increase in the annual sewer service charge
for our commercial property located at 480 San Ramon Valley Blvd. All expenses are
paid by our tenants, all small local family businesses. These poor people cannot take
any additional burdens for fees or taxes WHATSOEVER at this time. Business is way

commercial property in San Ramon. The proposed increases will involve
both of my properties.
I am adamantly opposed to raising these charges. In view of current
economic conditions, the CCCSD should be making every effort to maintain
or lower their current rate structure. Most private businesses and many
government agencies have made difficult reductions in their operating
budgets. ,The management of CCCSD should do the same!
As a former resident of San Leandro, I am familiar with the rate
structure of the Oro Loma Sanitary District. The OLSD currently charges
residential rate payers: $178 per year. CCCSD charges are already
substantially higher than the rates in the OLSD. Your proposed increase will
widen this marked disparity in charges. Clearly, the OLSD has managed to
control their expenses. I urge you to curb expenses at CCCSD, reconsider
these increases, and strive to maintain the current rate structure.
I regret that I will be out of town during your public hearing on June
3. Please accept this written statement in opposition to the proposed rate
increases.

Central Contra Costa Sanitary District:
I suppose I dont mind an increase in rates when you show what you have
done to rein in costs. You have failed to give any facts in the
increase. Cut expenses such as retreats in exotic places would be a
start. Look into out sourcing the Sanitary District and have an
outside agency run the business. The county does not need to run the
sanitary district when it can be run for half the cost. The county can
still make a profit without the contractual obliagations. What I find
abhorant is the increase in costs in a declining market. There is
simply no excuse! There is no accountability but bringing the
attention to yourselves via increase of rates is something that you
will have wished you had not done. There is a seathing discontent and
our Founding Fathers that said no taxation without representation,
will be your undoing. I simply encourage you to explain all the costs
you have and how much you have cut expenses and only then can you
resonably explain an increase in rates. You have not done your
homework in educating the communities. t look forward to June 3, 2010
at 2pm.

Attention :Secretary of The District,
My Name is John D. Oswell. I own a residence at 325 Alviso Way,
Danville, CA 94526.
I protest the increase in Sewer Service Charge announced in the
Subject Public Notice.
Among the reasons the citizens of California passed Proposition 218 is
to make clear what is a tax, make sure people know when they are
paying a tax and that the tax has been approved. The sewer service
charge which CCCSD is authorized to impose covers "operation,
maintenance, and construction of public sewer pipelines, pumping
stations, our wastewater treatment plant,and the pipeline that
discharges clean, treated, disinfected water to Suisun Bay." The
current residential rate for those services is $311 per year. As far
as I know there has been no voter authorization to divert any of those
monies to defray any other State of California expenses. The increase
proposed in the subject Public Notice is in violation of Proposition
218.
