ISSUE: On May 5, 2010, two (2) sealed bids were received and opened for the
construction of the Hall Drive Sewer Renovations, Phase 2B, District Project No. 5932.
The Board of Directors must award the contract or reject bids within 50 days of the bid
opening. Authorize the General Manager to execute the contract documents subject to
SUBMITTAL requirements.
RECOMMENDATION: Find that the project is exempt.from the California
Environmental Quality Act (CEQA), award a construction contract, and authorize the
General Manager to execute the Contract Documents subject to favorable review of
insurance certificates, bond submittals, appropriate Contractor license, and any other
required submittals (SUBMITTALS).
FINANCIAL IMPACTS: Approximately $1,611,000, including design, bid price,
contingency, and construction management.
ALTERNATIVES/CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: In 1991, the Hall Drive Sewer Improvements, Phase 2A, DP 4331 A,
constructed a deep sewer main in Hall Drive, Orinda. The sewer was installed using
the traditional open-cut method and construction was extremely disruptive to the
neighborhood. The second half of the project, Phase 2B, was delayed due to concerns
of disruption to the neighborhood.

~, The current Hall Drive Sewer Renovations, Phase 2B Project, will renovate or replace
2,600 linear feet of 6-inch sewer lines within easements. The existing rear yard
easement sewer crosses several creeks and is located in unstable soil. Construction of
these sewers will involve close cooperation with customers for site access and property
restoration. The Phase 26 Project will construct new sewers in front-yard easements
and tie them into the deep main within Hall Drive. The new sewers will be installed.
using horizontal directional drilling, a trenchless technology method. The house laterals
will be rerouted around or under the homes from the rear yard sewer to the new sewer
in the front yard. At 200 Hall Drive, the homeowner will install a private sewer lift station
in lieu of aDistrict-installed gravity sewer lateral, portions of which would have been
installed aboveground. The District will reimburse the property owner for the cost of the
lift station, which is estimated at $25,000. The project will also replace a line on
Queensbrook Place and a line on Camino Encinas (see Attachment 1).
District staff prepared the plans and specifications for the project. The Engineer's
estimate for construction of the Hall Drive Sewer Renovations, Phase 2B, is $850,000.
This project was advertised on April 16 and 21, 2010. Two (2) sealed bids, $741,870
and $798,557, were received and publicly opened on May 5, 2010. Only two bids were
received due to the specialized nature of the horizontal directional drilling trenchless
technology. The Engineering Department conducted a technical and commercial
review of the bids and determined that McNamara and Smallman Construction, Inc. is
the lowest responsive bidder with a bid amount of $741,870. A summary of bids
received is shown in Attachment 2.
The District will administer the construction contract and will provide contract
administration, survey, office engineering, and submittal review. Inspection services will
be provided by JN Engineering, a consultant. An agreement with JN Engineering is the
subject of a separate position paper. The funds required to complete this project, as
shown in Attachment 3, are $1,306,470. The total cost of the Hall Drive Sewer
Renovations, Phase 2B, is anticipated to be $1,611,470.
This project is included in the fiscal year (FY) 2009-10 Capital Improvement Budget
(CIB) on pages CS-21. Staff has conducted acash-flow analysis of the Collection
System Program budget and concluded that adequate funds are available for this
project.
Staff has concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines, Section 15302, since it involves
replacement of existing facilities with the same purpose and level of activity as the

facilities being replaced. Authorization of the construction contract for this project will
establish the Board of Directors' independent finding that the project is exempt from
CEQA.
RECOMMENDED BOARD ACTION: Find that the project is exempt from CEQA,
award a construction contract in the amount of $741,870 for the construction of the
Hall Drive Sewer Renovations, Phase 2B, District Project No. 5932, to McNamara and
Smallman Construction, Inc., the lowest responsive bidder, and authorize the General
Manager to execute the Contract Documents subject to SUBMITTAL requirements.
