Farrell K. A m mes M. K y, eneral Manager ISSUE: A Board of Directors' Resolution of Application is required to initiate formal Local Agency Formation Commission (LAFCO) annexation proceedings. RECOMMENDATION: Adopt a Resolution of Application to initiate LAFCO annexation proceedings for ten areas In Danville designated as District Annexation 179. FINANCIAL IMPACTS: The District incurs costs to prepare annexation applications and pays fees to LAFCO, the County Surveyor and the State Board of Equalization for annexation processing. Annexation costs are recovered as "annexation charges" when property is connected to the public sewer system. ALTERNATIVES/CONSIDERATIONS: The Board could decline to initiate annexation for these areas, which would require that the property owners apply directly to LAFCO for annexation to the District. BACKGROUND: Seventeen unannexed properties in Danville have been organized into ten separate "annexation areas" to eliminate "islands' within District boundaries. All of the annexation areas are within the District's Sphere of Influence (SOI) and the County Urban Limit Line. The general location of each annexation area is shown on Attachment 1. Staff has drafted a Resolution of Application requesting that LAFCO initiate annexation proceedings for the ten areas in Danville that are described below: Annexation Area 179-1 is comprised of four existing single family homes on Houston Court, West Prospect Avenue and Quinterra Lane. • Annexation Area 179-2 is comprised of one existing single family home on West Prospect Avenue. ADOPT A RESOLUTION OF APPLICATION REQUESTING THAT CONTRA COSTA LAFCO INITIATE PROCEEDINGS TO ANNEX TEN SEPARATE ANNEXATION AREAS IN DANVILLE (DISTRICT ANNEXATION 179) • Annexation Area 179-3 is comprised of one existing single family home on Estates Drive. • Annexation Area 179-4 is comprised of one existing single family home on EI Dorado Avenue. • Annexation Area 179-5 is comprised of one existing single family home on EI'Dorado Avenue. Annexation Area 179-6 is comprised of two existing single family homes on Sky Terrace. Annexation Area 179-7 is comprised of four existing single family homes on Buckeye Lane and Diablo Road. • Annexation Area 179-8 is comprised of one existing single family home on Danville Boulevard. Annexation Area 179-9 is comprised of one existing single family home on Danville Boulevard. • Annexation Area 179-10 is comprised of one church property on Danville Boulevard. District staff has concluded that annexation of each property in Annexation Areas 179-1 through 179-10 (inclusive) is exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines Section 15319, since each would involve annexation of existing lots for exempt facilities. Adoption of the recommended resolution will establish the Board of Directors' independent finding that annexation of these properties is exempt from CEQA. RECOMMENDED BOARD ACTION: Adopt a Resolution of Application to initiate LAFCO proceedings for District Annexation 179 including the finding that annexation of each property in Annexation Areas 179-1 through 179-10 (inclusive) is exempt from CEQA under District CEQA Guidelines Section 15319.
