FARRELL, DIRECTOR OF ENGINEERING~L,,~~~jj,, ~l FROM: CURTIS SWANSON, ENVIRONMENTAL SERVICES DIVISION V MANAGER o JARRED MIYATOMO-MILLS, PRINCIPAL ENGINEER ~~7q~0 SUBJECT: RESPONDING TO REQUESTS REGARDING THE AVAILABILITY OF CCCSD SEWER SERVICE SUMMARY: Recently there have been three inquiries regarding extending sewer service to areas outside the County Urban Limit Line. Staff suggests that it would be appropriate to review these situations with the Board to ensure that our responses to these inquiries are consistent and clearly reflect Board policy. FACILITY CAPACITY AVAILABILITY AND ALLOCATION: Our current practice is to make capacity available to new connections on a first come, first served basis. Capacity is not committed to any connector until they pay their connection fees. Therefore, when a project is in the planning stages, parties inquiring about sewer service are told that we have limited capacity and it is available on a first come, first served basis. For the last 30+ years, this has not been an issue, as we have had adequate permitted capacity. In 2002, our permitted capacity of 53.8 mgd was projected to be adequate to serve all planned development through 2035, even under the most conservative assumptions for ground water infiltration (see Figure 1). However, with the recent update of our collection system master plan, projected ultimate flows have increased due to increases in planned development. Now, under the high groundwater infiltration scenario, we project that treatment plant capacity may be exceeded as soon as 2028 without the Concord Naval Weapons Station development (Figure 2) and in 2025 with the Concord Naval Weapons Station development (Figure 3). These projections do not include reductions in base wastewater flow that may occur due to water conservation efforts or reduced groundwater infiltration that may result from ongoing renovation of public and private sewers. Treatment Plant capacity is based on handling both the wastewater flow and the sludge generated by removing pollutants from the wastewater during treatment. Responding to Questions Regarding the Availability of Sewer Service April 30, 2010 Page 2 of 4 The first Treatment Plant limitation will be furnace capacity. One furnace can process the sludge generated from the solids and BOD loading associated with an average daily flow volume during high groundwater infiltration periods of approximately 54 mgd. As we approach this flow rate, we will investigate increasing sludge handling capacity, perhaps by modifying or replacing the furnaces, or by hauling excess sludge some of ,the time. Development and implementation of a sludge handling capacity solution will take many years. Therefore, planning efforts should ideally be initiated 7-10 years before increased capacity is needed. Except for the Alhambra Valley, development outside.the Urban Limit Line is not included in the above projections and extending service to these areas could potentially create the need for new incinerators even sooner. Staff felt that the Board should be aware of this potential constraint as they consider stating a policy regarding serving development outside the Urban Limit Line (ULL). DEVELOPMENTS BEING CONSIDERED FOR SEWERING OUTSIDE THE ULL At this time, there are three areas proposed for development that could involve extending District sewer service outside the Urban Limit Line. They are as follows: CCCSD District Annexation 168C -Alhambra Vallev: In Alhambra Valley, there are nineteen parcels within CCCSD's Sphere of Influence, but outside of the Urban Limit Line. In response to Board direction, staff is preparing an EIR evaluating the environmental effects of annexing and sewering nine parcels adjacent to existing CCCSD sewers, four of which are developed with septic tank systems. To provide a comprehensive analysis, the EIR will also consider the later annexing and sewering of ten other nearby parcels that are also both within CCCSD's Sphere of Influence and outside the Urban Limit Line. The EIR will be distributed for public review soon after the May 6, 2010 Board meeting. San Ramon General Plan Amendment: The City of San Ramon is circulating a draft EIR, which evaluates the impacts of a proposed expansion of San Ramon's Urban Growth Boundary (its version of an ULL) and Sphere of Influence. Part of this expansion would incorporate two already developed areas, one sewered by CCCSD and one sewered by Dublin San Ramon Services District. The remainder of the proposed expansion would incorporate 1,626 acres in the southern portion of the Tassajara Valley. A portion of this Tassajara Valley area is also included in a proposed General Plan Amendment being processed by Contra Costa County as part of the "New Farm" development (See discussion below). As such, the City has not asked if CCCSD could provide sewer service to this area yet. ' Contra Costa County General Plan Amendment: As noted above,. the County just started processing a proposed General Plan Amendment for the New Farm development, a proposal for 771 acres in the unincorporated Tassajara Valley area east of Danville and San Ramon. The New Farm development will consist of two sites: 1) the Northern Site, 155 acres north of Camino Tassajara (43 homes): and 2) the Southern Site, 616 acres (142 homes) south of Camino Tassajara as shown on the attached map. San Ramon is proposing to include the southern portion of New Farm within its Sphere of Influence, as discussed above. As part of an "agency comment request," the County shared with District staff a memo from the New Farm engineer to the developer, stating that CCCSD could provide service to the Northern Site and that an alternative for the Southern Site could be developed to transport raw or treated wastewater to the existing CCCSD collection system in Camino Tassajara. We have not yet responded to the County regarding the New Farm engineer's suggested service alternatives. POLICY ISSUE The Board has consistently maintained that CCCSD is not a land use planning agency and that the District exists to provide sewer service to approved development. To maintain this important distinction, it is imperative that all requests regarding the availability of CCCSD sewer service be answered consistently. Our historical response to these request have been as follows: • CCCSD must be the logical wastewater utility service provider where service may be available from more than one agency. • We serve only approved development within CCCSD's annexed boundaries that has completed the appropriate planning and environmental review process, and for which there are adequate existing and/or planned CCCSD facilities. • The collection system and treatment facilities have a finite capacity. • Once development has been approved, availability of service is on a first come, first served basis. • Unless service by gravity is infeasible, pumped service will not be allowed. • Sewering property where there may be water quality degradation issues associated with septic tanks is appropriate. Going forward, staff recommends that we respond to requests regarding the availability of CCCSD sewer service as follows: A. For approved development that is both within CCCSD's annexed boundaries and the County Urban Limit Line, sewer service connections will be permitted, subject to the availability of facilities capacity and the other historical limitations stated above; B. For approved development in unannexed areas within both CCCSD's Sphere of Influence and the County's Urban Limit Line, property must first be annexed to CCCSD before sewer service connections may be permitted, subject to the availability of facilities capacity and the other historical limitations stated above; C. For approved development in unannexed areas within CCCSD's Sphere of Influence, but outside the County's Urban Limit Line, environmental review is required before annexation and sewer service proposals can be considered; D. For approved development in areas outside CCCSD's Sphere of Influence, but within the County's Urban Limit Line, property must first be included within the Sphere of Influence and annexed to CCCSD before sewer service connections may be permitted, subject to the availability of facilities capacity and the other historical limitations stated above; E. For approved development in areas outside both CCCSD's Sphere of Influence and the County's Urban Limit Line, CCCSD sewer service is generally not available and will not be considered unless detailed environmental review determines that it is required to mitigate a significant existing water quality degradation issue, the property is included within the Sphere of Influence, and annexed to CCCSD. Next year, staff will begin a study of treatment plant capacity and the implications of exceeding that capacity for two situations: one assuming that development of the former Concord Naval Weapons Station proceeds, and the second where it does not. The study will include developing an estimated cost for increasing sludge treatment and other capacity-related facilities needs, and will consider the financial implications of different funding options and connection fee. assumptions. Within CCCSD's annexed territory. B. Within both CCCSD's Sphere of Influence (SOI) and County Urban Limit Line (ULL). C. Within CCCSD's SOI, but outside the County ULL. D. Outside CCCSD's SOI, but within the County ULL. E. Outside both CCCSD's SOI and the County ULL. 1 Current Population Projection • The 2000 Collection System Master Plan Update - Projected "Build-Out" Population: 529,000 • The 2010 Collection System Master Plan Update - Projected "Build-Out" Population: 575,000 • Additional "Build-Out" Population per Land Use Planners Change in Population Projection: 46,000 (mostly densification) Treatment Plant Master Plan Update • Next year, staff plans to begin an update (included in 2010-11 CIB) - Two Scenarios: 1) WithoutCNWSdevelopment 2) With CNWS development - Will develop projected schedules & estimated costs: 1) Additional Sludge Treatment Capacity 2) Other Capacity-Related Needs 2 t How should staff respond to requests for service? (Same as for D.) 4 r Role of Contra Costa LAFCO • LAFCO sets District Sphere of Influence and boundaries, based on its determination of the most logical service provider considering multiple criteria per State law. • LAFCO may find that CCCSD is the logical service provider for an area even if it is located outside of the current SOI, where we have not planned service. Current Requests for Service Outside Urban Limit Line • Contra Costa County -Application for General Plan Amendment for New Farm development (General Plan Amendment study underway) • City of San Ramon -Draft General Plan 2030 includes southern portion Of New Farm (EIR has been distributed for review with comments due May 19, 2010) • Alhambra Valley -EIR under preparation by CCCSD (Draft scheduled for distribution in late-May 2010) 5 How does the New Farm Applicant's Proposal Address Sewer Service? • The New Farm engineer has proposed that CCCSD serve the Northern Site via a pumping station and forcemain connecting to an existing public sewer in Camino Tassajara. • The New Farm applicant has proposed that the Southern Site be served with septic tanks, an onsite community system, by DSRSD or by pumping to CCCSD. • New Farm is outside CCCSD's SOI and the County ULL. (Condition A) • San Ramon proposes to extend its SOI and "Urban Growth Boundary (UGB)" to include a portion of the Tassajara Valley designated the "Eastside Specific Plan Area," which includes the New Farm Southern Site. • Utility service providers will be identified when the Eastside Specific Plan is prepared. • The Eastside Specific Pan Area is outside CCCSD's . SOI. CCCSD has not planned to provide sewer service. (Condition C) • The owners of nine of these parcels near existing CCCSD sewers have requested sewer service. Four of these properties are developed. • The owners of some of the other. parcels are concerned about.annexation and growth inducing impacts. • The EIR addresses all 19 parcels, but only the nine parcels where CCCSD service has been requested are being considered for annexation at this, time. • Draft EIR will be ready for public release late-May.
