K eneral Man ger ISSUE: A Board of Directors' Resolution of Application is required to initiate formal Local Agency Formation Commission (LAFCO) detachment and annexation proceedings. RECOMMENDATION: Adopt a Resolution of Application to initiate LAFCO proceedings to detach two properties and annex three properties in five separate areas in incorporated and unincorporated Martinez, designated as District Reorganization 181 (DR 181). FINANCIAL IMPACTS: CCCSD incurs costs to prepare detachment and annexation applications and pays fees to LAFCO and the State Board of Equalization for detachment and annexation processing. These costs are recovered when affected properties connect to public sewers. ALTERNATIVES/CONSIDERATIONS: The Board could decline to initiate the proposed detachments and annexations, which would require that the property owners apply directly to LAFCO. BACKGROUND: On October 1, 2009, the Board adopted Resolutions 2009-093 and 2009-094, which proposed, in part, that properties in incorporated and unincorporated Martinez adjacent to CCCSD's mutual boundary.with the Mountain View Sanitary District (MVSD) be detached from or annexed to CCCSD. Subsequently, staff met with the MVSD's District Engineer and worked with LAFCO and Assessor's Office staff to identify a number of additional boundary change recommendations. Some of these changes will resolve issues identified during the CCCSD and MVSD Municipal Service Reviews that LAFCO completed in 2008. The general location of each area is shown on Attachment 1. A separate position paper on today's agenda addresses recommended Sphere of Influence (SOI) amendments needed to complete the proposed boundary changes. N:\ENVRSEC\Position PapersUAiyamoto-Mills\2010\181 Postilion Paper DDDA 03-01-2010 FINAL 3-18-10.doc Page 1 of 3 POSITION PAPER Board Meeting Date: March 18, 2010 subject ADOPT A RESOLUTION OF APPLICATION REQUESTING THAT CONTRA COSTA LAFCO INITIATE PROCEEDINGS TO DETACH TWO PROPERTIES AND ANNEX THREE PROPERTIES IN FIVE SEPARATE AREAS IN INCORPORATED AND UNINCORPORATED MARTINEZ (DISTRICT REORGANIZATION 181) Staff has drafted a new Resolution of Application to bring together one of the annexations proposed in Resolution 2009-093, one of detachments proposed in Resolution 2009-094, and the additional recommended detachments and annexations in a request that LAFCO now initiate proceedings to detach two properties and annex three properties in the five separate areas in incorporated and unincorporated Martinez described below: • District Reorganization Area 181-1 irvolves CCCSD annexation of one property on Pomona Avenue currently developed with asingle-family home, as well as a portion of Walnut Street in Martinez. The existing home is served by CCCSD's public sewer system. Concurrently, MVSD will detach this area. • District Reorganization Area 181-3 involves CCCSD detachment of property on Imhoff Drive comprised of the Household Hazardous Waste Collection Facility, the commercial property at.4737 Imhoff Place and a portion of Imhoff Place to create a logical boundary. These facilities are served by MVSD's public sewer system. Concurrently, MVSD will annex this area. • District Reorganization Area 181-4 involves only a change in the CCCSD/MVSD mutual SOI to exclude one vacant developable property on Central Avenue in unincorporated Martinez from CCCSD's SOI. This property can be most reasonably served by MVSD: No detachments or annexations are recommended in the area at this time. • District Reorganization Area 181-5A involves CCCSD annexation of property comprised of a portion of one common area property near Douglas Drive and a portion of State Highway 4 in Martinez to create a logical boundary. Concurrently, MVSD will detach this area. • District Reorganization Area 181-561 involves CCCSD detachment of property comprised of a portion of one existing multiple-family residential property on Vista Oaks Drive in Martinez to create a logical boundary. This property is served by MVSD's public sewer system. Concurrently, MVSD will annex this area. • District Reorganization Area 181-562 involves CCCSD annexation of a portion of a City of Martinez's Water Storage Facility property to create a logical boundary. Concurrently, MVSD will detach this area. ADOPT A RESOLUTION OF APPLICATION REQUESTING THAT CONTRA COSTA LAFCO INITIATE PROCEEDINGS TO DETACH TWO PROPERTIES AND ANNEX THREE PROPERTIES IN FIVE SEPARATE AREAS IN INCORPORATED AND UNINCORPORATED MARTINEZ (DISTRICT REORGANIZATION 181) CCCSD staff has concluded that the detachment or annexation of each property as proposed for District Reorganization Areas 181-1 through 181-5 (inclusive) is exempt from the California Environmental Quality Act (CEQA) under. CCCSD CEQA Guidelines Section 15319, since each would involve detachment or annexation of an existing lot for existing or exempt facilities. Adoption of the recommended resolution will establish the Board of Directors` independent finding that annexation and detachment of these properties are exempt from CEQA. RECOMMENDED BOARD ACTION: Adopt a Resolution of Application requesting that LAFCO initiate proceedings to detach two properties and annex three properties in five separate areas in incorporated and unincorporated Martinez, including the finding that the annexation or detachment of each property as proposed for District Reorganization Areas 181-1 through 181-5 (inclusive) is exempt from CEQA under CCCSD CEQA Guidelines Section 15319.
