ISSUE: A Board of Directors' Resolution of Application is required to initiate formal
Local Agency Formation Commission (LAFCO) Sphere of Influence (SOI) change
proceedings. '
RECOMMENDATION: Adopt a Resolution of Application to initiate LAFCO SOI change
proceedings for five areas in Martinez designated as District Reorganization 181.
FINANCIAL IMPACTS: CCCSD incurs costs to prepare SOI change applications and
pays fees to LAFCO for SOI amendment processing. These costs are recovered when
affected properties connect to public sewers.
ALTERNATIVES/CONSIDERATIONS: The Board could decline to initiate the SOI
change for the five areas which would require that the property owners apply directly to
LAFCO.
BACKGROUND: On October 1, 2009, the Board adopted Resolution 2009-092, which
proposed changes in the mutual SOI between CCCSD and the Mountain View Sanitary
District (MVSD) for three SOI amendment areas. Subsequently, staff met with the
MVSD's District Engineer and worked with LAFCO and Assessor's Office staff to
identify a number of additional SOI and boundary change recommendations. Some of
these changes will resolve issues identified during the CCCSD and MVSD Municipal
Service Reviews that LAFCO completed in 2008. A separate position paper on today's
agenda addresses the recommended detachments and annexations needed to
complete the proposed boundary changes. The location of each SOI Amendment Area
is shown on Attachment 1.
Staff has drafted a new Resolution of Application to replace Resolution 2009-092 and
request that LAFCO now initiate SOI change proceedings for the three original and two
additional SOI amendment areas described below:

• District Reorganization Area 181-1 changes the SOI to include the property at
2220 Pomona Avenue as well as a portion of Walnut Street in Martinez. This
property is connected to CCCSD's public sewer system.
• District Reorganization Area 181-2 changes the SOI to include the property at
4833 Venner Road in Martinez. This property is connected to CCCSD's public
sewer system.
• District Reorganization Area 181-3 changes the SOI to exclude the portion of
CCCSD's facilities on Imhoff Place that are served by MVSD and a portion of
Imhoff Place to create a logical boundary. These facilities include the Household
Hazardous Waste Collection Facility and the commercial building at 4737 Imhoff
Place.
• District Reorganization Area 181-4 changes the SOI to exclude a vacant
developable property on Central Avenue in unincorporated Martinez. This
property can be most reasonably served by MVSD.
• District Reorganization Area 181-5A changes the SOI to include the portion of a
common area property near Douglas Drive in Martinez; the majority of which is
already within CCCSD's boundaries, and an adjacent portion of State Highway 4
to create a logical boundary.
• District Reorganization Area 181-5B1 changes the SOI to exclude the portion of
the property at 3430 Vista Oaks Drive in Martinez. The property is currently
served by MVSD.
• District Reorganization Area 181-562 changes the SOI to add the portion of a
City of Martinez's Water Storage Facility property not already within CCCSD's
SOI.
CCCSD staff has concluded that the changes in the CCCSD/MVSD mutual SOI
proposed for each affected property is exempt from the California Environmental
Quality Act (CEQA) under CCCSD CEQA Guidelines Section 15319, since each action
would involve an SOI change affecting an existing lot for existing or exempt facilities.
Adoption of the recommended resolution will establish the Board of Directors`
independent finding that the SOI change for each affected property within District
Reorganization Areas 181-1 through 181-5 (inclusive) is exempt from CEQA under
CCCSD CEQA Guidelines Section 15319.

LAFCO initiate proceedings to amend CCCSD's mutual SOI with the MVSD, including
the finding that the SOI change proposed for each affected property within District
Reorganization Areas 181'-1 through 181-5 (inclusive) is exempt from CEQA under
CCCSD CEQA Guidelines Section 15319.
