ISSUE: The District has received a claim for the amount paid by Encompass to repair
their insured's vehicle. The insured, JoAnn Stockman, claimed that damage to her
vehicle resulted from driving over an uncovered manhole in Lafayette on December 12,
2009.
RECOMMENDATION: Deny the claim.
FINANCIAL IMPACTS: Denying the claim has no fiscal impact.
ALTERNATIVES/CONSIDERATIONS: The alternative is to accept the claim and pay
Encompass Insurance $2,439.74.
BACKGROUND:
Ms. JoAnn Stockman filed a claim with her auto insurer, Encompass Insurance, to
repair damage to her vehicle. She reported that the damage was caused when she
drove over an uncovered manhole on Rheem Blvd, Lafayette on December 12, 2009.
Safety & Risk Management staff was advised by Encompass of its intent to file a claim
to recover its costs. While awaiting the claim, staff photographed the location of the
open manhole as described by Encompass's insured.
Upon receipt of the Encompass Insurance claim and photographs provided by Ms.
Stockman, staff was able to determine that the open manhole shown in the photograph
was a storm drain cover which did not belong to the District.
RECOMMENDED BOARD ACTION: Deny the claim.
