FarrellFarrell ---~ Ja Kelly eneral Manager ISSUE: Several aspects of the 1987 Pretreatment Program Memorandum of Understanding (MOU) do not reflect current practices between the District and -City of Concord. The updated MOU establishes an agreement on updated current practices. RECOMMENDATION: Authorize Pretreatment MOU for the District to continue conducting pretreatment program activities in the City of Concord's sewer service area. FINANCIAL IMPACTS: The MOU provides for reimbursement of the District's costs for the pretreatment program in the City of Concord and therefore there are no financial impacts. ALTERNATIVES/CONSIDERATIONS: Do not process this updated Pretreatment MOU and continue operating under the original 1987 pretreatment MOU. This is not recommended as the MOU should reflect current practices. BACKGROUND: In the early 1980s, the U.S. Environmental Protection Agency and S.F. Bay Regional Water Quality Control Board required the District to ensure that an adequate pretreatment program was implemented in the City of Concord's service area to protect the District's treatment plant's operations. The options considered were either: • Concord develop their own pretreatment program that met the federal standards with the District's oversight to ensure their program protected the District's operations; • Enter into an interagency agreement for the District's Source Control Section to implement the District's approved pretreatment program in Concord's sewer service area. It was determined to be more efficient and protective for the District to implement the pretreatment program in Concord's sewer service area. The District and Concord entered into an interagency agreement authorizing the District to implement the Inirlaring Depr.~Dlv.: Engineering/ Environmental Services POSITION PAPER Board Meeting Date: February 18, 2010 subject: AUTHORIZE AN UPDATED PRETREATMENT PROGRAM MEMORANDUM OF UNDERSTANDING WITH THE CITY OF CONCORD pretreatment program in Concord's sewer service area through an amendment to the 1974 agreement for sewer service in 1985. The 1987 MOU was developed to establish the responsibilities for the District and Concord staff under this amendment. A recent review of the 1987 MOU identified current reporting, responsibilities, and contact information were not up to date. District and city staffs have updated the Pretreatment MOU. The current practice of the District implementing the pretreatment program in Concord's sewer service area with their reimbursement has been cost efficient and protective for the District's operations. District Counsel has reviewed the proposed MOU. RECOMMENDED BOARD ACTION: Authorize an updated Pretreatment MOU for the District to continue conducting pretreatment program activities in the City of Concord's sewer service area.
