ISSUE: Board of Directors' authorization is required for the General Manager to
execute a professional services agreement in an amount greater than $50,000.
RECOMMENDATION: Authorize the General Manager to execute a technical
consulting services agreement with Kellco-Macs with a cost ceiling of $75,000 for the
Treatment Plant Hazard Identification, District Project 7284.
FINANCIAL IMPACTS: The planning cost of the project will be approximately $90,000.
ALTERNATIVES/CONSIDERATIONS: An alternative would be to hire additional staff.
The broad range of professional expertise needed would require hiring numerous
people. It has been the District's practice to augment staff with consultants on specialty
designs and larger projects. Additionally, Kellco-Macs performed the hazardous
material surveys at the treatment plant in the past and is knowledgeable with the
District's facilities.
BACKGROUND: A treatment plant-site survey to identify locations of hazardous
materials will help safeguard Treatment Plant Operations and Maintenance staff from
unknowingly exposing themselves to a potential health risk during the course of their
work. Exposure amounts and durations are limited by CaIOSHA. Knowledge of these
materials ahead of time allows staff to properly prepare and equip themselves with
Personal Protective Equipment (PPE), monitors, or plan for medical surveillance.
District staff performs urgent, and sometimes unscheduled, work to maintain operation
of the facility, which hinders the ability to conduct testing in advance of their work to
determine if hazardous materials are present and allow proper planning or mitigation to
occur.

Additionally, design engineers can include abatement work in the bid documents,
instead of having to issue change orders. The recent HVAC project required a change
order to abate asbestos in the Treatment Plant Operations Building, which was found in
pipe insulation. This was unknown before the project and required temporary relocation
of the staff and immediate abatement of the asbestos. This encounter was not
anticipated and highlights the need to identify such materials ahead of time so that staff
is aware of their location and can plan work accordingly. Furthermore, regulations
require the due diligence of the District to notify contractors of any hazardous materials
that they may encounter in their work.
The survey will be conducted throughout the treatment plant to identify hazardous
materials and will be documented in a database. The treatment plant-wide survey will
take approximately 1200 samples to be tested for asbestos, 75 samples for CAM 17
(the seventeen CAlifornia regulated Metals), and will document other hazardous
materials as discovered. All information will be documented in a report and input into a
database for easy access. This survey will identify hazardous materials in the
treatment plant which may stimulate future mitigation projects.
In November of 2009, a request for proposal was sent to three firms: AEI Consultants,
SCA Environmental, and Kellco-Macs. Proposals were received from all three firms
and interviews were conducted with the top two. Based on the proposals and
interviews, staff recommends Kellco-Macs for the hazardous materials survey of the
treatment plant. A technical consulting services agreement with a cost ceiling of
$75,000 has been negotiated with Kellco-Macs.
The Treatment Plant Hazard Identification, DP 7284, is included in the current Fiscal
Year Capital Improvement Budget on pages TP-22, which is part of the Treatment
Plant Safety Improvements Program. Staff has determined that there are adequate
funds available and that the expenditure requirements are consistent with the
Treatment Plant Program.
Staff has concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines Section 15301 since it involves
minor alterations to an existing public facility. Approval of this project will establish the
Board of Directors' independent finding that this project is exempt from CEQA.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute a
technical consulting services agreement with Kellco-Macs with a cost ceiling of $75,000
for the Treatment Plant Hazard Identification, District Project 7284.
