ISSUE Board of Directors' authorization is required for the General Manager to
execute a technical consulting services agreement in an amount greater than $50,000.
RECOMMENDATION Authorize the General Manager to execute technical consulting
services agreements with Associated Right of Way Services, Inc. (ARWS) and Paragon
Partners Ltd. (Paragon) respectively, for right -of -way consulting and title research
services.
FINANCIAL IMPACTS The proposed two -to -three year cost ceiling for ARWS is
$226,000. The proposed cost ceiling for Paragon is $50,000.
ALTERNATIVES /CONSIDERATIONS There will continue to be a need to use outside
consultants such as ARWS and Paragon to assist District right -of -way staff to provide
services to assist with property rights acquisition and title research.
BACKGROUND Permanent easements, temporary construction easements, and
other property rights need to be acquired to support the District's sewer renovation
projects. In the past, property rights have typically been acquired by a combination of
District staff and outside real property consultants. During peaks in project workloads
consultants are used to supplement District staff in researching existing property rights
by performing title research services, providing administrative support, and providing
consultation during complex property rights negotiations.
A Request for Proposals (RFP) process to select right -of -way consultants was held
during the fall of 2010. Seven RFPs were sent out to firms with California offices that
specialize in right -of -way acquisition for public agencies. Six proposals were evaluated.
All firms were asked to provide their experience, references, client list, employee list,
fee schedule, resumes of proposed staff and sub - consultant list if applicable. Through a
rating system the top three most qualified firms were selected for an interview.

District staff concluded that ARWS was the most qualified firm to provide right -of -way
consulting services. ARWS proposed staff with significant experience in title and
property rights research.
ARWS, under its current technical consulting services contract, has been assisting the
staff with various capital projects and general real property assignments since
November 2006. Some of the projects include Orinda Sewer Renovation Projects,
Diablo Sewer Renovation Project, Lafayette Sewer Renovation Projects and Walnut
Creek Sewer Renovation Projects. Additionally, ARWS has assisted staff in
researching various title issues pertaining to easements, District fee property and land
valuation tasks. ARWS has performed well on all assignments.
In the past, Paragon has also provided services to the District on a case -by -case basis,
which includes the preparation of a "Shell Pipeline Market Study" completed in 2006.
As Paragon is considered a leader in pipeline and utility research, having their firm
under contract would be valuable for coordinating project work with private and public
utilities, as all agencies must now compete for limited space within congested utility
corridors. Since the need for this type of consulting services work is infrequent, a
smaller contract with Paragon is appropriate.
The recommended agreements would be for as needed services over two to three
years.
RECOMMENDED BOARD ACTION Authorize the General Manager to execute a
technical consulting services agreement with Associated Right of Way Services, Inc.,
and Paragon Partners Ltd. with cost ceilings of $226,000 and $50,000, respectively, for
as needed right -of -way consulting and title services over the next two to three years.
