Farrel a .Kelly, General Manager ISSUE: Board of Directors' authorization is required for the General Manager to execute professional engineering services agreements for amounts greater than $50,000. RECOMMENDATION: Authorize the General Manager to execute a professional engineering services agreement with RMC Water and Environment in the amount of $130,000 for preparation of a facilities plan for sewering redevelopment of the .Concord Naval Weapons Station (CNWS) property, as described in the Concord Community Reuse Plan (CCRP). FINANCIAL IMPACTS: The total cost of preparing the facilities plan for the CNWS is estimated to be $180,000, including staff time. On-site mains and trunks required to serve the CNWS redevelopment project would be constructed by the developers.. Off-site trunks and pumping station facilities would be paid for by the developers. ALTERNATIVES/CONSIDERATIONS: The Board could decline to authorize preparation of the facilities plan at this time. This is not recommended because the City of Concord is moving forward with planning for redevelopment of the CNWS, and it is prudent for the District to plan for improvements and costs for providing wastewater services. BACKGROUND: The planned redevelopment of the Concord Naval Weapons Station (CNWS) property will require the District to plan new sewers, make changes to existing sewers, and improve pumping stations. While the need for this infrastructure is several years in the future, it is prudent to have a clear understanding of changes that N:\ENVRSEC\position papers\chesler\2010\PP for Sewerage FP for CCRP -FINAL 8-5-10 Page 1 of 3 POSITION PAPER Board Meeting Date: August 5, 2010 subject: AUTHORIZE THE GENERAL MANAGER TO EXECUTE A PROFESSIONAL ENGINEERING SERVICES AGREEMENT WITH RMC WATER AND ENVIRONMENT IN THE AMOUNT OF $130,000 FOR PREPARATION OF A SEWER FACILITIES PLAN FOR THE CONCORD NAVAL WEAPONS STATION (CNWS) REDEVELOPMENT will be required in the local pumping stations and the construction required to add new trunks and upsize existing trunks in the North Concord area, as well as the appropriate timing for each of these. In January 2010, the Concord Community Reuse Project Final Environmental Impact Report (EIR) was completed; it includes requirements to provide wastewater services to .about 29,000 people, 12,300 housing units and more than 8.5 million square feet of commercial, institutional, and other community facilities. As CNWS redevelopment plans proceed, the facilities plan will form the basis of future work to ensure that appropriate sewer and pumping station projects are identified for timely inclusion in the District's Capital Plan and that CCRP's appropriate contribution to the cost of the projects can be recovered. The consultant selection process began in May 2010 for the recycled water facilities plan. A formal request for proposals (RFP) was prepared and sent to three qualified engineering consultants. Proposals were received from two firms, Carollo Engineers and RMC Water and Environment. With the need to also begin the sewer system planning for CCRP and the potential synergy between the sewer and recycled water infrastructure, the two consultants were also asked to present their qualifications on preparing a sewer facilities plan for the CNWS redevelopment. Each consultant has extensive experience in both recycled water and sewer facilities planning. Staff evaluated the written proposals and conducted formal interviews on June 22, 2010. Based on their past experience and proposed approach to the recycled water and sewer planning, Carollo Engineers was selected to prepare the Recycled Water Facilities Plan, and RMC Water and Environment was selected to prepare the Sewerage Facilities Plan for the CCRP. A separate position paper has been prepared for authorization of a consulting agreement with Carollo Engineers to prepare a recycled water facilities plan. Staff has negotiated a professional engineering services agreement with RMC Water and Environment to complete the facilities plan for sewer service to the CCRP with a cost ceiling of $130,000. The scope of work consists of confirming and refining land use and flow projections, defining existing improvement needs in North Concord, developing and evaluating conceptual sewerage plans and alternatives, reviewing potential sewer alignments, and developing a recommended Sewerage Facilities Plan report. There is adequate budget in the Collection Systems Program to fund preparation of this facilities plan. Staff has concluded that the proposed agreement with RMC Water and Environment is exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines Section 15262 since it involves planning tasks for possible future actions which the District has not approved, adopted, or funded, and the outcome of these tasks will not have a legally binding effect on later activities. Approval of this agreement will establish the Board of Directors' independent finding that this agreement is exempt from CEQA. The District will conduct an environmental evaluation of any capital project that is proposed in the future as a result of the Facilities Plan to determine the appropriate CEQA compliance documentation. RECOMMENDED BOARD ACTION: Authorize the General Manager to execute a professional engineering services agreement with RMC Water and Environment in the amount of $130,000 for preparation of a facilities plan for sewering redevelopment of the Concord Naval Weapons Station (CNWS) property, as described in the Concord Community Reuse Plan.
