S ' cki A. Farrell Ja es M elly, Genera anager ISSUE: The Board of Directors' authorization is required to amend consulting agreements beyond staff's authority. RECOMMENDATION: Authorize the General Manager to execute an amendment to an existing consulting agreement. FINANCIAL IMPACTS: The cost ceiling on the existing agreement will be increased by $42,000. ALTERNATIVES/CONSIDERATIONS: Direct staff to self-perform the work, which is not recommended since staff does not possess the welding experience/certifications. BACKGROUND: Since the new CSOD administration and crew building is a steel structure, the City building permit and the California Building Code require that a certified inspector be present any time welding for the project occurs, be it shop fabrication or field erection.. Bobo Construction listed Bay Cities Fabrication out of White City, Oregon, as their steel fabricator/supplier. The District retained RES Engineers, Inc. (RES) to provide welding inspection for both shop fabrication and field erection of the steel. RES was selected because they possess the necessary welding certification/experience and have a certified inspector who happens to reside near White City, Oregon. Staff negotiated a cost reimbursement agreement with RES with anot-to-exceed limit of $42,000. The agreement limit allowed for six weeks of shop fabrication time, which was the time estimated by Bobo Construction and Bay Cities Fabrication. IN THE AMOUNT OF $42,000 FOR THE CONSTRUCTION OF THE CSOD ADMINISTRATION, CREW, AND WAREHOUSE FACILITY, DISTRICT PROJECT NO. 8208 take 12 weeks (6 weeks longer). This delay is due primarily to the lengthy wet weather season this year, which prolonged the schedule for steel fabrication. This delay was outside the control of the .contractor, fabricator, and inspection consultant. Staff has negotiated a revision to the agreement limit with RES to increase the amount by $42,000, bringing the total agreement amount to $84,000. Staff recommends the continued use of RES since they are familiar with the work and have the necessary staff available at the fabrication site. The environmental impacts of the CSOD Administration, Crew, and Warehouse Facility were addressed in the Collection System Operations (CSO) Facilities Improvements Project Mitigated Negative Declaration approved by the Board of Directors on December 21, 2007. Subsequently, a Notice of Determination was filed in compliance with the California Environmental Quality Act (CEQA). RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an amendment to an existing professional services agreement with RES Engineers, Inc. in the amount of $42,000.
