Bailey General Manager L eah C astella District Counsel IS S UE C entral San has sewer infrastructure in need of immediate replacement, specif ically, the force mains (pressurized sewers) that transport the raw wastewater from the Martinez P umping Station to the F airview Pumping S tation. T he f orce mains have been repaired on two occasions within the last two years, and staf f recommends f ull replacement of force mains sections as soon as possible. T he construction work requires permitting, and emergency action is required to obtain the necessary emergency permits in an expedited manner f or the needed work. B AC K G RO UND T he existing dual 20-inch cement mortar-lined and coated-steel force mains from the Martinez P umping Station were constructed in 1968 and convey raw wastewater to a discharge structure located within the Martinez R efining C ompany’s (MR C ) property. E ach force main is roughly a mile in length and situated on easements just North of Marina Vista Avenue in Martinez and along the Union P acif ic R ailroad’s (UP R R) May 16, 2024 Regular Board Meeting Agenda Packet - Page 493 of 500 Page 1 of 8 right-of -way prior to entering the MR C secured f acility as shown in Attachment 1-Project L ocation Map. I n November 2022, Engineering was notif ied of a leak at one of the force mains on the UP R R right-of -way. Operations quickly responded and stopped the leak by shutting down the f orce main and draining the sewage within the pipeline back to the Martinez P umping Station. W hile the force main was empty, staff did a closed-circuit television inspection on the upper portion of the pipeline near the discharge structure, including the failed pipe location. Based on the video and external inspection, staf f determined that the force main has various levels of corrosion with the most severe being observed internally at the top of the pipeline f or the last 300 feet. T his type of corrosion is common for force mains that experience hydrogen sulfide gas pockets or are not fully filled with wastewater, causing sulf uric acid build-up that deteriorates the cement lining and steel pipe. C apital Projects obtained a contractor to make an urgent repair that involved steel mesh, mortar, and a carbon-reinf orced f iber wrap. T he repair was completed, and Operations returned the f orce main to service before several large winter storms. T he f orce mains can experience a large range of flows f rom 1 million gallons per day (MG D) during dry weather to over 12 MG D during peak wet weather events. A f ter the repair and additional inspection of the aerial crossings, staff identified a second failing location that has severe corrosion on the exterior of the pipe. T his second location could not be easily seen on the initial inspection due to difficulty in accessing the aerial crossing in the refinery. After reviewing several project alternatives, staff decided that the best alternative was to remove and replace the last 650 f eet of both existing force mains. T his option will remove the medium- to more severe- corroded sections and replace all of the force mains on UP R R’s right-of-way and MR C ’s property. T he new pipeline is designed using P V C and will be installed within steel casings f or the aerial crossings by C arollo Engineers, I nc. (C arollo). T he location of the force mains adjacent to the railroads and nearby utilities makes the replacement work very complicated and poses various construction challenges and risks. T hese challenges include limited access for replacing the aerial crossing and building the new pipe supports. T he risks include working near high-pressure gas lines, Kinder Morgan pipeline, and other utilities. S taff has been coordinating with the utilities and pipeline owners to safely perf orm the construction activities. A caref ul and highly qualified pipeline contractor with relevant experience, J MB C onstruction I nc. (J MB), was hired by C entral San to perform all the necessary investigation and construction work for the second repair and full replacement of the end of the f orce mains. To date, the second repair has been completed, the utilities within the work area have been identified and located, all the coordination with the ref inery and utilities have been established, and the necessary construction materials, pipes, and appurtenances have been received by J MB . T he replacement work is ready to proceed with the exception that the final permit by the UP R R has not been received. C oordinating and obtaining a permit f rom UP R R has been a very slow process and began over a year ago. Staf f have been diligent with providing notif ications and contacting several sources within UP R R to seek guidance and find alternatives to assist in receiving the permit. S taff, C arollo, and J MB have been in contact with UP R R subcontractors for safety and construction assistance. T he two repairs completed on the force mains are intended to be temporary, and there are remaining portions of the pipelines that are in the same condition and highly likely to leak or fail. T heref ore, staff recommend completely replacing the sections as soon as possible. To expedite the permit process with UP R R, an emergency declaration is required and will allow the contractor to proceed with the replacement work under emergency UP R R coordination or permitted conditions. C entral San has an easement on the UP R R property that states that the D istrict has the rights to maintain, operate, and construct the facilities. A ll conditions within the easement have been f ulf illed under the May 16, 2024 Regular Board Meeting Agenda Packet - Page 494 of 500 Page 2 of 8 project, including written communications and notices. C alifornia E nvironmental Quality Act (C E Q A) Staf f has concluded that this P roject is exempt from C E Q A under C entral San's C E Q A Guidelines Section 15302, since it involves replacement of existing public facilities at the same location and with the same purpose. A pproval of this Project will establish the B oard's independent finding that this Project is exempt f rom C E Q A. ALT E RNAT I V E S /C O NS I D E RAT IO NS None. F I NANC IAL I M PAC T S T here are minor permitting fees associated with the emergency work, however the costs were budget at time of award of the project. T here are no additional financial impacts, the costs f or coordinating and obtaining permits were included in the total estimated project budget of $3,962,000 as authorized by the Board on S eptember 7, 2023. C O M M UNI T Y O UT RE AC H C entral San staff has been and continues to notif y and coordinate the sewer construction work with the ref inery and others on this critical project. C O M M I T T E E RE C O M M E ND AT IO N D ue to the urgent nature of this subject, staff requested an emergency action by the General Manager and to be ratif ied at the next scheduled Board Meeting. Map Displayed in North American Datum of 1983 California State Plane, Zone III FIPS 0403, US Feet ·|}þ 1 Attachment Waterfront Park Detail Area ·|}þ44 Lafayette Walnut Creek Pleasant Hill Concord Martinez 680 R Amtrak - Martinez May 16, 2024 Regular Board Meeting Agenda Packet - Page 497 of 500 Page 5 of 8 ATTACHMENT 2 RESOLUTION NO. 2024-010 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT CONFIRMING AND DECLARING A PERMITTING EMERGENCY FOR THE PARTIAL REPLACEMENT OF THE MARTINEZ PUMPING STATION FORCE MAINS ADJACENT TO THE UNION PACIFIC RAILROAD AND WITHIN THE MARTINEZ REFINING COMPANY PROPERTY WHEREAS, a capital improvements project, Martinez Urgent Force Main Replacement, District Project No. 100066, was identified in the Collection System Sewer Renovation, Phase 2, District Project 100039 and included in the Fiscal Year (FY) 2023-24 budget for construction to occur by the end of FY 2023-24 period; WHEREAS, on September 7, 2023, the District's Board of Directors (Board) authorized award of a construction contract to JMB Construction Inc. (JMB) to temporarily repair, investigate the site conditions, coordinate the construction with the refinery and all utility agencies, and obtain the necessary materials and piping for replacement work activities; WHEREAS, the District and consultant engineer, Carollo Engineers, determined that replacement is needed up to 650 feet on each force main (pressurized sewer pipeline) as there are two existing 20-inch force mains that are installed in parallel. These force mains are underground and exposed as an aerial crossing over a concrete utility channel at the Martinez Refining Company (MFC); WHEREAS, the design has been verified and preconstruction activities have been coordinated and completed with JMB to locate and pothole the nearby utilities, including high-pressure gas lines and Kinder Morgan fuel pipelines, and all materials and piping have been received; WHEREAS, the District has property easements with the Union Pacific Railroad (UPRR) and the MFC, which both have been properly notified per the easement agreements of the need to urgently perform project work and through other coordination and permitting efforts; WHEREAS, District staff and its consultant have attempted for over a year to obtain a final permit from the UPRR through standard processes with minimal success; WHEREAS, given the deficiencies in the force mains and the potential for an inoperable sewer system as the assets near the end of their useful life, and the known corrosion issues that have already resulted in two sewer spills, and potential for future leaks or failures of the force mains with the potential to impact and affect the health and safety of the public, the Board of Directors has determined that an emergency exists and the necessary steps must be taken to meet the emergency and commence the replace the force mains as determined under the Project; May 16, 2024 Regular Board Meeting Agenda Packet - Page 498 of 500 Page 6 of 8 Central Contra Costa Sanitary District Resolution No. 2024-010 Page 2 of 3 WHEREAS, this situation has arisen through detailed investigation, and involves a clear and imminent threat, demanding immediate action to prevent or mitigate loss of, or damage to, life, health, property, and essential public services; and WHEREAS, in order to expeditiously obtain the necessary permits from UPRR, the District must declare that performance of this Project work must be performed on an emergency basis; and WHEREAS, section 22050 of the California Public Contract Code provides that in cases of emergency and pursuant to a four-fifths vote, the Board of Directors may take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes; and WHEREAS, Public Contract Code section 22050 further provides that in cases of emergency and pursuant to a four-fifths vote, the Board of Directors may also delegate the authority to procure the necessary equipment, services, and supplies to a specified and appropriate District manager; and WHEREAS, the California Environmental Quality Act establishes a statutory exemption for emergency repairs to public service facilities necessary to maintain service, and other specific actions necessary to prevent or mitigate an emergency. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Board) as follows: The Board finds, pursuant to Public Contract Code section 22050(a), that based on substantial evidence presented before the Board, the emergency will not permit further delay resulting from awaiting permit documentation from UPRR for the repair of the District’s Martinez Pumping Station Force Mains, and that this action is necessary to respond to the emergency; THAT District staff will proceed to obtain all necessary regulatory authorizations for the replacement work on an expedited basis using all available emergency procedures with UPRR; THAT District staff will request all governmental entities with authority over this replacement to expedite their consideration of the matter and to use available emergency procedures to ensure that this repair is completed in a timely manner so as to avoid the harms that would result from a catastrophic failure of the system; and THAT the Board will review the status of the emergency at each subsequent meeting of the Board of Directors and vote to authorize continuation of this Resolution until the emergency action is completed.
