BAILEY, GENERAL MANAGER SUBJECT: RECEIVE INFORMATION ON INDUSTRIAL USERS OF CENTRAL CONTRA COSTA SANITARY DISTRICT'S PUBLIC SEWER SYSTEM FOUND TO BE INSIGNIFICANT NON-COMPLIANCE FOR 2023 Federal pretreatment regulations establish standards that apply to wastewater agencies with approved pretreatment programs. One of these standards specifies criteria to evaluate violations at regulated businesses to determine if the business is in Significant Non -Compliance (SNC). When a business is determined to be in SNC, Central Contra Costa Sanitary District (Central San) is required to report this status in reports submitted to the Regional Water Quality Control Board and publish information about the violation in the newspaper at least annually. For the calendar year 2023, three businesses were determined to be in SNC: Compliance sampling conducted at the Acme Fill Corp. from their wastewater discharge resulted in violations of Federal Gross Beta Radioactivity limits once during the second quarter reporting period and Federal Gross Alpha Radioactivity limits once during the third quarter reporting period. I n both instances, the level of exceedance met the Technical Review Criteria established for SNC. Central San issued Notices of Violation (NOVs) for the violations. The I U stated the landfill has never accepted radioactive materials and does not know of any other sources that could have caused the high results. The I U and Central San temporarily increased monitoring for both parameters since no obvious source has been located. Resampling demonstrated that the I U returned to compliance. Bay Area Rapid Transit- Concord Shop failed to provide their required Periodic Compliance Report within 45 days after the due date during the third quarter reporting period. The late report met the criteria established for SNC. Central San issued a Notice of Violation (NOV) for the violation. Central San is working with the I U to submit a complete Periodic Compliance Report. February 1, 2024 Regular Board Meeting Agenda Packet - Page 102 of 130 Page 2 of 3 Compliance sampling conducted of the discharge from the Life Science Building at Diablo Valley College resulted in violations of Central San's Local Discharge Limit (LDL) for copper and mercury once during the first quarter reporting period. Additionally, compliance sampling conducted of the discharge from the Physical Science Building resulted in a violation of Central San's Local Discharge Limit (LDL) for Total Toxic Organics during the third quarter reporting period. I n each instance, the level of exceedance met the level of exceedance established for S NC. Central San issued Notices of Violation (NOVs) for the violations. The I U investigated potential sources of copper and mercury within the Life Science laboratory operations and did not locate any significant sources. The I U flushed the waste lines from the Life Science Building to remove potential legacy sources of copper and mercury. The I U investigated sources of Total Toxic Organics within the Physical Science building and determined the event was likely due to an accidental discharge; they will educate staff and students on proper collection procedures. Resampling demonstrated that the I U returned to compliance in both the Life Science and Physical Science buildings. Environmental Compliance staff will continue to work with these businesses to maintain compliance with the pretreatment standards. Attached is the SNC notice scheduled for publication in the Contra Costa Times and San Ramon Valley Times, the East Bay Times circulation areas, in early February 2024. Notice of Significant Non-Compliance_2023 February 1, 2024 Regular Board Meeting Agenda Packet - Page 103 of 130 Page 3 of 3 PUBLIC NOTICE CENTRAL CONTRA COSTA SANITARY DISTRICT NOTICE OF SIGNIFICANT NON-COMPLIANCE FOR 2023 Notice is hereby given that pursuant to the federal regulations contained in 40 CFR 403.8.f(2)(vii), Central Contra Costa Sanitary District (Central San) is required to publish the names of all Industrial Users (IUs) of Central San's public sewer system that were determined to be in Significant Non -Compliance (SNC) with applicable pretreatment standards or other pretreatment requirements during the 2023 calendar year. Federal regulations establish objective criteria for Central San to use to determine if an IU is in SNC. Discharge Quality Violations The following IUs were found to have discharged process wastewater in violation of Central San's Local Discharge Limits in a manner that met the definition of SNC. Industrial User Nature of Violation Follow-up Action Taken Acme Fill Corporation Limit violations for Central San issued Notices of Violation (NOVs) 950 Waterbird Way Radioactivity- Gross Alpha & for the violations. The IU flushed the discharge from the Physical waste lines from the Life Science Building to Science building in remove potential legacy sources of copper and concentrations that met the mercury.
