Bailey General Manager ISSUE Section 6490 of the Health and Safety Code of the State of California provides that District ordinances shall be published once in a newspaper of general circulation within the District, and further stipulates a subsequent order of the Board that the ordinance had been published shall constitute conclusive evidence that publication has been properly made. BACKGROUND Summary of codified District Ordinance No. 331, which was adopted by the Board on December 21, 2023, was published on December 29, 2023 in the Contra Costa Times and San Ramon Valley Times, circulation areas of the East Bay Times. Ordinance No. 331 amended a portion of the District Code Chapters 6, 7 and 10, specifically Section 6.12.070, Section 7.03.020, Section 10.12.050 and Section 10.32.035. The revised code became effective on January 5, 2024. ALTERNATIVES/CONSIDERATIONS Confirming publication of the ordinance summary establishes presumption that the ordinance was correctly published and therefore would be deemed procedurally valid by a court.
