Bailey General Manager ISSUE A Resolution of the Board of Directors (Board) is required to execute a Quitclaim Deed and to record the documents with the Contra Costa County Clerk -Recorders Office. However, the grants of easements offered to Central San do not require Board action since the General Manager is authorized to accept grants of easements or offers of dedication in favor of Central San and to negotiate and purchase grants of easements up to $200,000. BACKGROUND The Pleasant Hill Sewer Renovations, Phase 2, DP 5991, requires the realignment of a sewer located at 399 Gregory Lane, Pleasant Hill. Right -of -Way staff contacted the property owners who agreed to an easement exchange whereby Central San will quitclaim the original easement rights in exchange for them granting a new easement to realign the sewer as shown in Attachment 1 - Easement Exchange. November 2, 2023 Special Board Meeting Agenda Packet - Page 20 of 79 Page 2 of 5 ALTERNATIVES/CONSIDERATIONS The Board could decline to authorize the Quitclaim for the existing easement. However, this alternative is not recommended since Capital Projects' engineers have determined a new alignment is more beneficial to Central San, and the property owners are agreeable to the exchange. FINANCIAL IMPACTS Since this is an easement exchange, there is no direct purchase cost for the new grant of easement. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on October 18, 2023 and recommended approval. RECOMMENDED BOARD ACTION Adopt the Proposed Resolution authorizing (1) execution of a Quitclaim Deed related to the Pleasant Hill Sewer Renovations, Phase 2 (DP 5991), and (2) staff to record the documents with the Contra Costa County Clerk -Recorder's Office. Rev. riAq O'1 22 of 34 Page 4 of 5 ATTACHMENT 2 RESOLUTION NO. 2023-047 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT AUTHORIZING EXECUTION OF QUITCLAIM DEED TO THE EPISCOPAL CHURCH OF THE RESURRECTION IN PLEASANT HILL, CALIFORNIA, DISTRICT PROJECT PLEASANT HILL RENOVATION PROJECT PHASE 2 PLEASANT HILL, APN 152-138-014 WHEREAS, Central Contra Costa Sanitary District (Central San) plans to realign the sewer located at 399 Gregory Lane, Pleasant Hill for Pleasant Hill Sewer Renovations Phase 2, DP 5991; WHEREAS, property owners Episcopal Church of the Resurrection (Episcopal Church) have agreed to an easement exchange whereby Central San will quitclaim the original easement rights in exchange for the property owners granting a new easement to realign the sewer; and WHEREAS, Central San has prepared the attached Quitclaim Deed relinquishing the original easement rights to the Episcopal Church; and WHEREAS, the Episcopal Church have executed a Grant of Easement conveying new easement rights to Central San. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District as follows: THAT Central San consents to the execution of the attached Quitclaim Deed to The Episcopal Church in connection with the Pleasant Hill Sewer Renovations, Phase 2, District Project 5991, dated November 2, 2023; and THAT Central San accepts the easement rights offered in the Grant of Easement executed by the Episcopal Church to Central San; and THAT the President of the Board of Directors and the Secretary of the District are hereby authorized to execute said documents for and on behalf of Central San; and THAT staff is authorized to record said documents in the Office of the Recorder of Contra Costa County.
