ISSUE
Board approval is required to amend an existing Board Policy.
BACKGROUND
On October 4, 2023, Senate Bill 616 was passed which amended the Healthy Workplaces/Healthy
Families Act of 2014 to increase the statutorily required sick leave to temporary employees.
I n 2014, the Healthy Workplaces/Healthy Families Act was passed which required all employers in
California to provide all employees with a minimum of 24 hours of sick leave in a 12 month period.
Pursuant to the passage of this Act, the Board adopted Board Policy No. 018 to codify this requirement.
The policy now needs to be revised to reflect the passage of Senate Bill 616 which increases the sick
leave accruals from the current 24 hours a year to 40 hours per year.
The revised policy is attached reflective of this change.
ALTERNATIVES/CONSIDERATIONS
Do not approve the amendment to increase the sick leave for temporary employees. This is not
recommended as the passage of this senate bill statutorily requires the District to increase the amount of
sick leave hours for temporary employees.

FINANCIAL IMPACTS
Since the number of temporary employees is variable as well the predicted usage of the sick leave, we
anticipate the cost of this action to be within the $4,000 to $11,000 range per year.
COMMITTEE RECOMMENDATION
The Administration Committee reviewed this matter at its October 31, 2023 meeting and recommend
RECOMMENDED BOARD ACTION
Approve proposed changes to Board Policy No. B P 018 - Sick Leave for Temporary Employees to
increase the annual allotment of sick leave from 24 to 40 hours per year.

BOARD POLICY
SICK LEAVE FOR TEMPORARY EMPLOYEES
PURPOSE:
S
To establish a policy for implementing Assembly Bill 1522 codified as Labor Code
Sections 245 through 249 (also known as the Healthy Workplaces/Healthy Families Act
of 2014), which would provide District temporary employees with sick leave.
POLICY:
• It is District policy to comply with the provisions set forth in the Healthy
Workplace/Healthy Families Act of 2014 (Labor Code Sections 245-249). For
those items that allow the District to have discretion when implementing the act,
the District will provide for the following:
o Annual Grant: The District will grant five three (53) days of paid sick leave
within a twelve-month period.
o Sick Leave Use: Employees may use their paid sick leave beginning on their
90th day of employment. Employees may determine how much sick leave he
or she needs to use with a minimum usage of two (2) hours per incident.
o Terminal Sick Leave: Employees are not paid for unused paid sick leave upon
termination of employment.
