BAILEY, DEPUTY GENERAL MANAGER ISSUE A Resolution of the Board of Directors (Board) is required to execute a Quitclaim Deed and to record the documents with the Contra Costa County Clerk -Recorders Office. However, the grants of easements offered to Central San do not require Board action since the General Manager is authorized to accept grants of easements or offers of dedication in favor of Central San and to negotiate and purchase grants of easements up to $200,000. BACKGROUND The Pleasant Hill Sewer Renovations Phase 2, DP 5991, requires realignment of a sewer located at 399 Gregory Lane, Pleasant Hill. Right -of -Way staff contacted the property owners who agreed to an easement exchange whereby Central San will quitclaim the original easement rights in exchange for them granting a new easement to relalign the sewer as shown on Attachment 1 - Easement Exchange. October 17, 2023 Special REEP Committee Meeting Agenda Packet - Page 7 of 31 Page 2 of 5 ALTERNATIVES/CONSIDERATIONS The Board could decline to authorize the Quitclaim for the existing easement. However, this alternative is not recommended since Capital Projects' engineers have determined a new alignment will be more beneficial to Central San and the property owners are agreeable to the exchange. FINANCIAL IMPACTS Since this is an easement exchange, there is no direct purchase cost for the new grant of easement. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on October 18, 2023 and recommended RECOMMENDED BOARD ACTION Adopt the Proposed Resolution authorizing (1) execution of a Quitclaim Deed related to the Pleasant Hill Sewer Renovations, Phase 2 (DP 5991), and (2) authorize staff to record the documents with the Contra Costa County Clerk -Recorder's Office. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District as follows: THAT Central San consents to the execution of the attached Quitclaim Deed to The Episcopal Church in connection with the Pleasant Hill Sewer Renovations, Phase 2, District Project 5991, dated 2023; and THAT Central San accepts the easement rights offered in the Grant of Easement executed by the Episcopal Church to Central San; and THAT the President of the Board of Directors and the Secretary of the District are hereby authorized to execute said documents for and on behalf of Central San; and THAT staff is authorized to record said documents in the Office of the Recorder of Contra Costa County.
