BAILEY, GENERAL MANAGER SUBJECT: RECEIVE ANNUAL RIGHT-OF-WAY REPORT On January 19, 2023, the Board approved Resolution 2023-002 which authorized staff to accept easements and rights-of-way for sewer/recycled water that were obtained voluntarily and at no cost to Central San. Staff committed to report all easement acceptances for the prior fiscal year(FY)to the Real Estate, Environmental and Planning Committee and then the full Board. Staff also has the authority under Resolution 2021-008 to execute and record Real Property Agreements for any existing and/or proposed Class One as well as existing Class Two encroachments as defined by District Code 7.15.010. Therefore, staff has prepared a summary of all right-of-way transactions recorded by staff with the Contra Costa County Clerk-Recorder during FY 2022-23 for the Board's review. Using the General Manager's delegated authority in Resolutions 2023-002 and 2021-008, there were two grants of easements and six real property agreements recorded, respectively. The remaining 36 items were specifically authorized by the Board of Directors. Staff will present the attached report, which summarizes the recorded right-of-way for FY 2022- 2023, during the meeting and answer any questions.
