ISSUE
A Resolution of the Board of Directors (Board) is required to execute Quitclaim Deeds and to record the
documents with the Contra Costa County Clerk -Recorders Office. However, accepting irrevocable offers
of dedications for easement purposes that were acquired at no -cost to Central San do not require Board
action since the General Manager or their designee is authorized to accept grants of easements or offers
of dedication in favor of Central San.
BACKGROUND
Faria Preserve is a multi -phased development in the northwest area of San Ramon. The initial developer,
Faria Preserve, LLC and the subsequent developer, Toll West Coast, LLC, constructed new public

sanitary sewers within lands that included map offers of dedication (map offers) in favor of Central San for
sanitary sewer easement purposes.
As the public sewers have been accepted, staff will execute and record the map offer acceptances via a
certificate of easement acceptance document.
In an earlier phase of development, the initial developer recorded a Grant of Irrevocable Offer of
Dedication for Sanitary Sewer Purposes (IOD) for a future sewer extension. However, the subsequent
developer revised the street layout that made this recorded I OD unnecessary. As no public sewer was
constructed and Central San did not accept the IOD, staff recommends that this unused IOD be
quitclaimed to the property owner at this time.
ALTERNATIVES/CONSIDERATIONS
The Board could decline to quitclaim the recorded I OD as Central San did not accept the offer for
easement purposes; however, this is not recommended as the offer clouds the "chain of title" for lands
without a public sewer.
FINANCIAL IMPACTS
None. The developers paid the fees to process the right-of-way documents and to record this resolution.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on August
23, 2023 and recommended Board approval.

AUTHORIZING EXECUTION OF A QUITCLAIM DEED
TO TOLL WEST COAST, LLC

NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Central Contra
Costa Sanitary District (Central San) as follows:
THAT Central San hereby consents to the execution of a Quitclaim Deed to Toll West
Coast, LLC, a Delaware limited liability company, or current property owner at the time
of this recording, for a vacant parcel without a mailing address along Faria Preserve
Parkway, San Ramon (APN 208-880-023), Job 6711 (current), Job 6641 (former); and
THAT the President of the Board of Directors and the Secretary of the District are
hereby authorized to execute said document for and on behalf of Central San; and
THAT staff is authorized to record this resolution and associated documents with the
Contra Costa County Clerk -Recorder's Office.
