Bailey General Manager ISSUE The Board of Directors (Board) authorization is required for the General Manager to execute professional engineering agreements in an amount greater than $200,000. BACKGROUND Contra Costa Transportation Authority (CCTA) is improving the State Route 4/ Interstate 680 interchange. In advance of the next stage of improvements, CCTA requires the relocation of Central San's 84 -inch reinforced concrete pipe (RCP) commonly referred to as the A -Line along the east side of Interstate 680, as well as a portion of the 8 -inch main on the west side of I nterstate 680 flowing into a 12 -inch main across the freeway. Approximately 2000 linear feet (LF) of the A -Line must be relocated along Berry Drive in unincorporated Contra Costa County, as shown in Attachment 1, and the existing facilities will be abandoned in-place. On June 15, 2023, the Board approved a Utility Relocation Agreement with CCTA to September 7, 2023 Regular Board Meeting Agenda Packet - Page 47 of 160 Page 2 of 4 reimburse all costs for the design phase for this project; a subsequent agreement will be executed for the construction costs prior to that phase of the project. Staff prepared and posted a Request for Proposal (RFP) to PlanetBids on May 30, 2023, notifying all interested firms of the proposed scope, qualifications, and schedule. Additionally, staff emailed the RFP to six consultant firms experienced in large diameter pipe design and met with five firms to discuss the project specifics, which included CDM Smith, Brown & Caldwell, Carollo Engineers, Delve Underground (formerly McMillan Jacobs Associates), and Woodard & Curran. While several firms had expressed interest, only one proposal was received on July 14, 2023 from Carollo Engineers for $999,875. Several qualified firms responded that their resources were already committed to other projects during this twelve- month design schedule. Staff reviewed the proposal and then Carollo participated in an interview on August 11, 2023, which included a CCTA representative, per the evaluation criteria published in the RFP. Staff confirmed that Carollo Engineers meets the experience and qualification requirements, and has a reasonable scope, schedule and budget. Carollo Engineers designed the last large sewer project for Central San (A -Line Relief Interceptor, Phase 2A, District Project No 5980) which installed a 96 -inch interceptor across Buchanan Golf Course in 2008. Furthermore, Carollo Engineers has subcontracted with the same geotechnical engineer (Dru Nielsen formerly with DCM Joyal, then McMillan Jacobs Associates, now with Delve Underground) from that project; and will subcontract with other local firms that have worked on Central San projects for surveying, utility locating and potholing. Key deliverables from this Professional Engineering Services Agreement are development of Final Plans and Technical Specifications and an Engineer's Estimate of Probable Cost for submittal to CCTA by September 2024 in compliance with the Utility Reimbursement Agreement that was executed in June. The Engineer's Estimate of Probable Cost will aid CCTA in determining its full funding requirement for both the utility relocation and the larger State Route 4/1 nterstate 680 interchange improvement project. If there is insufficient funding, then CCTA may further phase this last stage of the interchange improvement project and staff anticipates that construction of the A -Line relocation would be concurrent with their first phase, such that the second phase would construct the fly -over ramp that is prompting the relocation of the A -Line along Berry Drive. Staff is requesting that the Board authorize execution of an agreement with a cost ceiling of $1,100,000, which includes optional tasks to investigate potential conflict of an existing large diameter storm drain and design its relocation, if needed, and a constructability review. California Environmental Quality Act (CEQA) At its meeting on June 15, 2023, the Board found this project to be exempt from CEQA. ALTERNATIVES/CONSIDERATIONS The Board may decline authorization of the agreement. This is not recommended as the agreement provides design services for relocation of the A -Line Sewer which is required by CCTA. FINANCIAL IMPACTS While this project is included in the FY 2023-24 Budget on page 236, there will be no net impact to the Capital I mprovement Budget (CI B) or 10 -Year Capital I mprovement Plan (Cl P) since the costs will be reimbursed by CCTA as outlined in the Utility Relocation Agreement. The design phase will be fully reimbursed under the current agreement and a subsequent agreement will be executed for the construction costs since the existing 84 -inch, 12 -inch and 8 -inch sewer pipelines are September 7, 2023 Regular Board Meeting Agenda Packet - Page 48 of 160 Page 3 of 4 lawfully maintained in their present locations pursuant to rights superior to those of CCTA and, per California Streets and Highways Code Section 705, no credit is allowed due to age for publicly owned sewers. COMMITTEE RECOMMENDATION The Engineering and Operations Committee reviewed this matter at the August 14, 2023 Committee Meeting and recommended approval. RECOMMENDED BOARD ACTION Staff recommends the Board authorize the General Manager to execute the agreement with Carollo Engineers, I nc. in an amount not to exceed $1,100,000.
