ISSUE
Section 6490 of the Health and Safety Code of the State of California provides that District ordinances
shall be published once in a newspaper of general circulation within the District, and further stipulates a
subsequent order of the Board that the ordinance had been published shall constitute conclusive evidence
that publication has been properly made.
BACKGROUND
Summaries of codified District Ordinance No. 326, and uncodified District Ordinance No.324 - Revision to
Exhibit A, which were adopted by the Board on May 4, 2023, were published on May 11, 2023 in
the Contra Costa Times and San Ramon Valley Times, circulation areas of the East Bay Times.
Summary of uncodified District Ordinance No. 327, which was adopted by the Board on June 1, 2023,
was published on June 16, 2023 in the Contra Costa Times and San Ramon Valley Times, circulation
areas of the East Bay Times.

Summary of uncodified District Ordinance No. 328, which was adopted by the Board on June 15, 2023,
was published on June 22, 2023 in the Contra Costa Times and San Ramon Valley Times, circulation
areas of the East Bay Times.
Summary of uncodified District Ordinance No.329, which was adopted by the Board on June 1, 2023, was
published on June 14, 2023 in the Contra Costa Times and San Ramon Valley Times, circulation areas
of the East Bay Times.
Summary of uncodified District Ordinance No. 330, which was adopted by the Board on June 21, 2023,
was published on June 27, 2023 in the Contra Costa Times and San Ramon Valley Times, circulation
areas of the East Bay Times.
Ordinance No.324 - Revision to Exhibit A, updated the Capacity Fees, Rates and Charges that were
established on June 16, 2022 and became effective May 19, 2023.
Ordinance No. 326 amended Chapter 6.12 of the District Code, section 6.12.030 E and became effective
May 19. 2023.
Ordinance No. 327 adopted a Schedule of Recycled Water Charges in accordance with District Code
Chapter 6.38 and became effective July 1, 2023.
Ordinance No. 328 adopted a Schedule of Environmental and Development -Related Fees and Charges
in accordance with District Code Chapter 6.30 and became effective July 1, 2023.
Ordinance No. 329 adopted a Schedule of Capacity Fees, Rates, and Charges in accordance with District
Code Chapter 6.12 and became effective July 1, 2023.
Ordinance No. 330 adopted a Schedule of Sewer Service Charge Rates in accordance with District Code
6.24.030 and became effective July 6, 2023.
ALTERNATIVES/CONSIDERATIONS
Confirming publication of the ordinance summary establishes presumption that the ordinance was correctly
published and therefore would be deemed procedurally valid by a court.

Minimal cost associated to publication fees.

SCHEDULE OF RECYLED WATER CHARGES
IN ACCORDANCE WITH DISTRICT CODE CHAPTER 638
Ordinance No. 327 (uncodified) adopts an updated "Schedule of Recy-
cled Water Charges" including an increase of the Former Potable Users
(Class 1) rate from $4.15 to $4.27 per 1,000 gallons effective July 1, 2023,
and an increase to $4.40 per 1,000 gallons effective July 1, 2024. The or-
dinance includes an increase of the Former Canal (Raw) Users (Class II)
rate from $1.98 to $2.04 per 1,000 gallons effective July 1, 2023,
and an increase to $2.10 per 1,000 gallons effective July 1, 2024.

ronmental and Development -related Fees and Charges" where 10 fees

unit for FY 2024-25. The annual multifamily residential charge for apart-
ments, condominiums, duplexes, and mobile homes will decrease by
$32 per multifamily residential unit for FY 2023-24 and increase by $25
per multifamily residential unit for FY 2024.25. Non-residential sewer
service charge rates will increase by an average of 1% for FY 2023-24
and increase by 4.0% for FY 2024-25. Lastly, a new rate category for Ac-
cessory Dwelling Units was implemented as part of the schedule.
