May 4, 2023 Regular Board Meeting Agenda Packet - Page 24 of 218 Page 1 of 3 B AC K G RO UND On March 18, 2004, the B oard approved a lease with Bay A rea Cellular Telephone Company, dba AT &T W ireless P C S, I nc., which is now New Cingular W ireless P C S, L L C . T he purpose of the lease was to allow the installation of a wireless communications f acility in the upper yard at the C ollection System Operations (C S O) campus. T he facilities consist of equipment cabinets placed at ground level, surrounded by a security f ence, and antennae attached to the P G&E tower within the yard (see C S O site map on A ttachment 1). C ingular has requested to increase the current existing 445 square-foot (S F ) pad area to 460 S F, to install a Generac 30 K W standby diesel as a backup source during power outages or public safety power shutoffs. T he area increase will not af f ect C S O operations since the proposed expansion is along the property line and into a slope that will be leveled by the lessee. T his lease will not preclude other telecommunication companies f rom using the same P G&E tower. T he new lease will comply with the criteria set f orth in B oard Policy 043, Buffer Property Management, such as compatible use, market lease rates to provide additional revenue to Central S an and its ratepayers, and terms not to exceed ten years. ALT E RNAT I V E S /C O NS I D E RAT IO NS T he B oard may decline to establish the recommended public hearing date or may elect to choose a dif f erent date; however, a public hearing must be held, and the property must be declared as “currently un- needed” bef ore a lease can be executed. RE C O M M E ND E D B O ARD AC T I O N Set J une 1, 2023 at 2:30 p.m. as the date and time for a public hearing to receive comments to consider declaring a portion of the property located within 1250 S pringbrook R oad, Walnut C reek (A P N 177-270- 030) as currently unneeded, and authorizing the Board to enter into negotiations with New C ingular W ireless P C S, L L C ., for a new term up to ten years.
