SUBJECT: RESCHEDULE THIS NOTICED PUBLIC HEARING OF APRIL 20, 2023 TO
CONSIDER ESTABLISHING RECYCLED WATER (REW) RATES FOR THE
NEXTTWO FISCAL YEARS TO THE 2:30 P.M. JUNE 1, 2023 BOARD
MEETING; AND AUTHORIZE THE SECRETARY OF THE DISTRICT TO
PUBLISH THE PUBLIC HEARING NOTICES

ISSUE
California State Law, including Proposition 218, requires the setting and holding of a public hearing to
establish new ReW rates.
BACKGROUND
A public hearing to consider rate increases is required under Proposition 218. Due to an oversight on the
mailing of the ReW Proposition 218 notice, this previously schedule public hearing needs to be
rescheduled. I n order to meet the 45-day notice requirement, a new hearing date is proposed for the June
1, 2023 meeting. A public hearing at the first June meeting would provide sufficient time for any approved
rate changes to become effective July 1, 2023 for the new fiscal year.
ALTERNATIVES/CONSIDERATIONS
A public hearing is required. The Board could consider alternative times for the public hearing to promote
public attendance. Staff recalls such concerns expressed in past years. A time in the evening was

selected for FY 2014-15 and 2015-16 rate adjustments. Attendance figures were not materially different.
Regardless of the time of the public hearing, property owners and customers may still register opposition
through a written protest.
A mailing informing customers of the proposed rate adjustments, their ability to register a protest, and the
public hearing will be mailed at least 45 days prior to the hearing, as required by Proposition 218.
FINANCIAL IMPACTS
None by setting the public hearing.
COMMITTEE RECOMMENDATION
This matter was not reviewed by a Board Committee.
RECOMMENDED BOARD ACTION
Set a new public hearing date for June 1, 2023 at 2:30 p.m. to consider establishing new Recycled Water
Charge rates for the next two fiscal years; and authorize the Secretary of the District to publish the public
hearing notices.
