A R esolution of the B oard of D irectors (B oard) is required to execute a real property agreement and
authorizing staff to record documents with the Contra Costa County C lerk-Recorder.
B AC K G RO UND
Staf f received an application to review building plans for property located at 2623 Camino R amon, located
in the C ity of San Ramon for the construction of a photovoltaic system (solar panels) located in a business
park. Staf f identif ied that the conduit for the solar panels would encroach into a sanitary sewer easement.
T he existing 10-foot wide sanitary sewer easement was established in the Map of Subdivision 5967, filed June
January 19, 2023 Regular Board Meeting Agenda Packet - Page 68 of 319

23, 1981 in Book 253 of Maps on Page 49 with the Contra Costa County Clerk-Recorder.
T he applicant subsequently submitted an application for a real property agreement, as described in
C hapter 7 of the District Code to authorize their proposed C lass two encroachment. Staf f has determined
that this proposed C lass 2 encroachment will not negatively impact daily operations or maintenance and
would be documented through the agreement so their location is identified when the f uture renovation of
the pipe is necessary.
Additionally, the applicant requested changes to the standard agreement which were reviewed by District
C ounsel. T he final agreement reflects the changes that were approved by D istrict C ounsel.

1. R eject the request to authorize the proposed Class 2 encroachment. T his alternative is not
recommended since the property owner is willing to enter into the real property agreement in
compliance with District Code, and the encroachments will not impact daily operations or
maintenance and would be documented through the agreement to identif y their location when f uture
renovation of the pipe is necessary.
2. P rovide some other direction to staff.

A development-related f ee was paid by the property owner for the real property agreement as set by
D istrict Ordinance No. 321.

T he Real Estate, E nvironmental and Planning C ommittee reviewed this matter at its meeting on
D ecember 14, 2022 and recommended approval.

Adopt the proposed Resolution to authorize the execution of a Real Property A greement related to
property located at 2623 Camino R amon, located in the City of S an R amon and authorizing staf f to record
documents with the Contra Costa County C lerk-Recorder.

EXECUTING AND RECORDING A REAL PROPERTY AGREEMENT

BE IT RESOLVED by the Board of Directors of Central Contra Costa Sanitary District
(Central San) as follows:
THAT Central San hereby authorized to execute a Real Property Agreement with the
following property owner related to the indicated property:
Assessors’ Parcel No.: 213-133-083
Property Owner(s): Sunset Land Company, LLC, a California limited liability
company
Site Address: 2623 Camino Ramon, San Ramon, CA 94583
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said documents for and on behalf of Central San; and
THAT staff is authorized to record the documents with the Contra Costa County Clerk-
Recorder's Office.
