SUBJECT: RECEIVE UPDATE ON THE MOST RECENT MEETING OF THE BAYAREA
CLEAN WATER AGENCIES (BACWA)

Nutrients:
BACWA's consultant, Mike Falk, provided a summary of the draft 2022 Group Annual Report, which is
due February 1, 2023. His slides compared rainfall amounts, as well as ammonia, total inorganic nitrogen
(TI N), and total phosphorus loads. Overall, TI N loads are slightly higher than loads from the previous
reporting year but still lower than peak loads. Central San's were lower this year than the last year. The
Central Bay had the largest increase in TI N loads. There was an internal BACWA Nutrient Strategy
Meeting on January 6, 2023. Topics covered included how to calculate load caps and compliance, early
actors, multi -benefit projects, and funding.
Permit Adoptions:
Sanitary Sewer Systems General Waste Discharge Requirement (SSS WDR): The SSS WDR was
adopted, and the final order will be released by the end of December. The order's effective date is in June
2023. Many changes that BACWA and the California Association of Sanitary Agencies (CASA) urged
were accepted by the State Water Board during the extended draft review process.
The Mercury/Polychlorinated biphenyls (PCB) Watershed Permit: The permit was adopted by the
Regional Water Board on December 14, 2022, and goes into effect on February 1, 2023.
Other:
The BACWA Board will have its first regular meeting of 2023 with the Regional Water Board on January
17, 2023. For BACWA Executive Board meetings, January and February will continue to be virtual. The
Board will move to hybrid meetings at the East Bay Municipal Utilities District in March and at the San
Francisco Public Utilities Commission in April.
