ISSUE
State law and the Resolution of Intention passed by the Board of Directors (Board) on July 7, 2022
require that a public hearing be held to establish Houston Court Area CAD No. 2022-1.
BACKGROUND
On July 7, 2022 the Board adopted a Resolution of Intention to create the Houston Court Area CAD for
the purpose of installing sewer improvements on Quinnterra Lane and Houston Court in Danville. The
proposed Houston Court Area CAD complies with the Board Policy No. BP 010 - Contractual
Assessment Districts. Four properties could be served by a Houston Court Area CAD public sewer(see
Attachment 1).

While the I mprovement Act of 1911 states that CA Ds are "voluntary and imposed pursuant to
an agreement with an assessed property owner" and are not subject to the requirements of Proposition
218, Central San has adopted procedures for CAD formation which follow the requirements of Proposition
218 that are not in conflict with the voluntary nature of a CAD.
ALTERNATIVES/CONSIDERATIONS
The Board could select a different date for the public hearing, which would delay the CAD proceedings.
FINANCIAL IMPACTS
There are minor costs for publishing a legal notice advertising the public hearing and for staff
preparation and attendance. These costs will eventually be paid by the CAD participants. Subsequent
approval of the Houston Court Area CAD would commit Central San to finance up to $252,894 in sewer
improvements, which would be repaid by property owners. If approved, the Houston Court Area CAD will
be established as a separate project in the Capital Improvement Budget to track costs.
COMMITTEE RECOMMENDATION
This matter was not reviewed by a Board Committee.
RECOMMENDED BOARD ACTION
Set a public hearing for January 19, 2023, at 2:30 p.m. to consider establishing Houston Court Area
CAD No. 2022-1 in Danville.
