CLEAN WATER AGENCIES (BACWA)

Air:
The BACWA/Bay Area Air Quality Management District (BAAQMD) working group met for a third time on
October 17, 2022. The group continued to discuss collaboration, permitting, regulatory focus areas, and
staffing needs. BAAQMD is developing a permitting flow tracking system.
Nutrients:
Direction for the third Nutrient watershed permit continues to include a Bay -wide load cap using the
antidegradation rationale. Although all agencies are expected to be below their agency -specific load caps,
the Regional Board has stated that long-term planning should include nutrient reductions. In response to
Regional Boards' statement, BACWA is taking steps to re-evaluate nutrient reduction options at the
agency level in terms of short, medium, and long-term options. In addition to this evaluation, BACWA is
launching a communications Steering Committee and will set up regular Nutrient Steering Team meetings
to monitor the progress of nutrient -related works.
An update on the algal boom was presented to the San Francisco Board of Supervisors on October 17,
2022, at their hearing to address San Francisco's Plan to address San Francisco Bay (SFB) nitrogen and
phosphorus loading. The Regional Board, BACWA, Baykeeper, and the San Francisco Estuary Institute
(SFEI) gave presentations on regional actions currently underway to control nutrients to SFB.

Other:
The Governor signed Assembly Bills (AB) 1817 and AB 2771 to limit per -and polyfluoroalkyl substances
(PFAS) exposure. Beginning January 1, 2025, AB 1817 will ban the sale of PFAS-containing textiles, and

AB 2771 will ban the sale of PFAS-containing cosmetics.
AB 2247, a bill that would create a database to record the sale of items containing PFAS, was vetoed by
the Governor, citing the elevated cost of implementation.
The polychlorinated biphenyls (PCBs) and mercury (Hg) watershed permit tentative order was released on
October 11, 2022. The comment period closes on November 14, 2022. Central San has no changes to
the mercury load allocation or the concentration -based limits for PCBs or mercury.
