Bailey General Manager ISSUE On October 13, 2022, three sealed bids were received and opened for the as-needed District-wide Patch Paving contract. The Board of Directors (Board) must award the contract or reject the bids within 50 days of the bid opening. Authorization is also required for the General Manager to execute the Contract Documents subject to submittal requirements, and include up to a 30-percent contingency. BACKGROUND Central San routinely requires asphalt paving restoration due to sewer maintenance construction activities performed by the Collection System Operations Division (CSOD). The work generally consists of providing all labor, equipment, material, and traffic control to perform periodic asphalt paving repairs (patch paving) in Central San's service area. Patch paving includes milling and grinding, asphalt paving, slurry sealing, striping, and other related services. November 17, 2022 Regular Board Meeting Agenda Packet- Page 22 of 101 Page 2 of 4 Staff prepared the specifications and bid documents for this contract. The Engineer's estimate was $225,000 per year, with an optional extension for four additional, one-year periods totaling $1,125,000. The contract was advertised on September 22 and 29, 2022. Three sealed bids ranging from $102,675 to $188,200 were received and publicly opened on October 13, 2022. Staff reviewed the bids and determined that Always Paving, Inc. dba General Construction was the lowest responsive and responsible bidder, with a bid amount of$102,675.A summary of bids received is shown in Attachment 1. Central San will have the option to extend the contract for four additional one-year periods. California Environmental Quality Act(CEQA) Staff has concluded that this contract is exempt from CEQA under Central San's CEQA Guidelines Section 15301(b) since it involves minor alterations to existing, publicly owned streets or rights-of-way. Approval of this project will establish the Board's independent finding that this project is exempt from CEQA. ALTERNATIVES/CONSIDERATIONS Reject all bids and rebid the contract, which is not recommended. FINANCIAL IMPACTS Approximately$102,675 this year with the option to extend for four additional one-year periods totaling a minimum of$513,375 for five years. I n addition, the contract includes provisions to allow for pricing adjustments based on the Consumer Price I ndex(CPI) or the price of oil or asphalt. Central San can authorize price adjustments on a yearly basis or terminate the contract if pricing is not favorable to the District.A total contingency budget of$154,000, or$30,800 per year will be budgeted to cover additional paving needs or District authorized pricing adjustments. COMMITTEE RECOMMENDATION The Engineering and Operations Committee reviewed this subject at the meeting on November 2, 2022 and recommended approval. RECOMMENDED BOARD ACTION Staff recommends the following Board actions: 1. Find that the contract is exempt from CEQA; 2. Award a construction contract in the amount of$513,375 to Always Paving, Inc. dba General Construction for District-wide Patch Paving to the lowest responsive and responsible bidder; and 3. Authorize the General Manager to execute the Contract Documents subject to submittal requirements, and include up to a 30-percent contingency.
