CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: OCTOBER 20, 2022 SUBJECT: ADOPT RESOLUTION NO. 2022-076 ESTABLISHING A NEW RECREATIONAL VEHICLE WASTEWATER RECEIVING STATION (RV STATION) PROGRAM TO BEGIN IN 2023; AND FIND THE RV STATION PROGRAM IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITYACT (CEQA) SUBMITTED BY: INITIATING DEPARTMENT: DANEA GEMMELL, PLANNING AND ENG-PDS-DIVISION MANAGER DEVELOPMENT SERVICES DIVISION MANAGER Roger S. Bailey Kenton L. Alm General Manager District Counsel ISSUE Approval of the Board of Directors (Board) is required to adopt resolutions. BACKGROUND Staff received requests to consider constructing a RV Station in FY 2019-21. An article was included in the Fall 2020 Pipeline asking customers if this type of facility is something they would use. Of the 136 responses returned, there was an overwhelming majority answering yes it would be utilized. An additive alternative bid in the amount of$9,300 to construct the RV Station was included in the Contractor Staging Project, District Project 7375. On April 6, 2021 staff provided an update to the Administration Committee and solicited input on options regarding service level, operating hours, and fees to be charged for the service. The Committee agreed with staff's recommendations that the RV station should be run as a self-service facility similar to the truck October 20, 2022 Regular Board Meeting Agenda Packet- Page 76 of 143 Page 2 of 11 fill station and open Monday through Saturday. The Committee also recommended that the service should be at no charge to participants for the first few years to establish the program. The Board could then reconsider charging users for the service, including users out of Central San's service area. Capital Projects is finalizing the completion of the Contractor Staging Project. The RV Station is complete but does not currently include equipment for charging customers. Conduits and power was included in the design should this be needed in the future. Staff estimates $25,000-$30,000 to install this equipment within a six-to-nine month timeframe. On October 4, 2022 staff reviewed the proposed operation of the RV Station with the Administration Committee.After a healthy discussion the Committee recommended that the self-service RV station be operated for three years at no charge as a pilot program. The hours of operation are recommended as 7:00 am to 7:00 pm for seven days a week. Staff will report back to the Board after the first year on these hours of operations to determine if revisions are needed. California Environmental Quality Act (CEQA) Staff has concluded that the proposed project is categorically exempt from the California Environmental Quality Act(CEQA) pursuant to 15061(b)(3) of Central San's CEQA Guidelines, in that the project is covered by the general rule exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. This certainly comes from the limited environmental disturbance produced by operation of such a facility at an existing wastewater treatment plant. Project approval by the Board of Directors constituted an independent finding that the project is exempt from CEQA. ALTERNATIVES/CONSIDERATIONS The Board could decline to approve the Resolution. FINANCIAL IMPACTS No additional financial impacts by this action. COMMITTEE RECOMMENDATION The Administration Committee reviewed this matter at its meeting on April 6, 2021 and recommended approval. The item has not gone back to the full Board because staff was waiting for construction to be completed. Supply shortages have delayed the completion; therefore, staff brought this item back to the Administration Committee to reaffirm its recommendation to the Board. Minor revisions were recommended to operational hours as discussed above. The Administration Committee revisited this matter at its meeting on October 4, 2022 and recommended approval. RECOMMENDED BOARD ACTION Adopt the revised proposed resolution to: 1) Establishing a new RV Disposal Program scheduled to start January 1, 2023 after the RV Receiving Station is constructed; and 2) Find the RV Station Program is exempt from CEQA. Presentation October 20, 2022 Regular Board Meeting Agenda Packet- Page 78 of 143 Page 4 of 11 ATTACHMENT 1 RESOLUTION NO. 2022-076 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ESTABLISHING A NEW THREE-YEAR PILOT RECREATIONAL VEHICLE WASTEWATER RECEIVING STATION (RV STATION) PROGRAM EFFECTIVE JANUARY 1, 2023 WHEREAS, Central Contra Costa Sanitary District (Central San) has, over the last several years, identified a prevalent sanitation issue related to waste from recreational vehicles and the unhoused dumped into the environment; and WHEREAS, the community has requested that Central San establish a RV Station; and WHEREAS, Central San's core mission is to protect public health and the environment as a sanitary agency; and WHEREAS, the establishment of a RV Station program would further Central San's mission to protect public health and the environment by encouraging the proper discharge of sewage within its boundaries, thus improving regional water quality; and WHEREAS, facilities were constructed at the treatment plant as part of the Contractor Staging Project, District Project 7375; and WHEREAS, the Board of Directors finds that it is necessary to encourage wide-spread use of the RV Station program to get it up and running. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Central San, as follows: THAT a three-year pilot program called RV Station Program for encouraging the community to properly discharge their waste at the treatment plant is hereby approved; and THAT staff is directed to implement the pilot RV Station Program for a three-year period effective January 1, 2023, under the following conditions: 1. The RV station will operate as a self-serve facility for the public seven days a week from 7:00 am to 7:00 pm; and 2. In order to encourage use of the facility, no fees will be charged to discharge into the RV Station, until it is reviewed again near the conclusion of the three-year pilot period.
