CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: OCTOBER 20, 2022 SUBJECT: ADOPT RESOLUTION 2022-075 AUTHORIZING THE EXECUTION OF A GRANT OF EASEMENT TO CONTRA COSTA WATER DISTRICT FOR ACCESS OVER PORTION OF THE OUTFALL PROPERTY, 5050 IMHOFF ROAD IN MARTINEZ SUBMITTED BY: INITIATING DEPARTMENT: DAVID KRAMER, REAL PROPERTYAGENT ENGINEERING AND TECHNICAL SERVICES - PDS - DEVELOPMENT SERVICES - RIGHT OF WAY REVIEWED BY: DANA LAWSON, SENIOR ENGINEER DANEA GEMMELL, PLANNING AND DEVELOPMENT SERVICES DIVISION MANAGER Roger S. Bailey Kenton L. Alm General Manager District Counsel ISSUE Board of Directors (Board) authorization is required to convey real property rights. BACKGROUND Contra Costa Water District (CCW D) requested a 20-foot wide access easement over land owned in fee by Central San for the Outfall property. CCWD's Shortcut Pipeline Project requires approximately 2,000 square feet of land for ingress and egress only, and the access easement will not include any rights to store, stage or build any improvements on the property. October 20, 2022 Regular Board Meeting Agenda Packet- Page 25 of 143 Page 2 of 4 ALTERNATIVES/CONSIDERATIONS The Board could decline to authorize the access easement to CCW D. However, this is not recommended because the access easement benefits a public utility without impacting Central San's services and CCW D could condemn for the property rights. FINANCIAL IMPACTS CCW D will pay Central San for the access easement based on a market appraisal. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on July 20, 2022 and recommended approval. RECOMMENDED BOARD ACTION Adopt the proposed resolution authorizing the execution of a Grant of Easement to CCW D for access over a portion of the Outfall property.
