BAILEY, GENERAL MANAGER SUBJECT: RECEIVE UPDATE ON ACCESSORY DWELLING UNIT DETERMINATION AND DEED RESTRICTION USAGE FOR SUCH MATTERS On July 1, 2021, the Board received an overview on Accessory Dwelling Units (ADUs), including a discussion on deed restrictions placed upon parcels for structures that meet all of the criteria of an AD U, but where property owners disagree with the designation. For units that are deemed an AD U, these structures are subject to Capacity Fees and Sewer Service Charges (SSCs) requirements. A hearing was also scheduled for the J my 1, 2021 meeting to consider an appeal for a pool cabana at 115 Poshard Street in Pleasant Hill that was deemed an AD and subject to the associated Capacity Fees and SSCs requirements. Staff supported the applicant's request and recommended the Board grant the appeal contingent on the recording of a deed restriction. It was stated that the use of deed restrictions is reasonable and provides a means to deal with the current use of a proposed structure as well as any potential change of use in the future. The Board granted the appeal and determined that the proposed structure does not meet the criteria for an additional dwelling unit subject to recording a deed restriction, thereby exempting it from Capacity Fees and annual SSCs. Staff will provide the Board an update on the use of deed restrictions in determining whether a parcel is considered an ADU. I n the past year, no other applicants have requested relief or disagreed with staff's determination of an AD requiring the use of a deed restriction.
