CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: SEPTEMBER 1, 2022 SUBJECT: APPROVE PROPOSED SALARY INCREASE OF SEVEN AND ONE-HALF PERCENT FOR SECRETARYOF THE DISTRICT KATHERINE YOUNG, AS SET FORTH IN THE SIXTH AMENDMENT TO HER FEBRUARY 11, 2018 EMPLOYMENT AGREEMENT, EFFECTIVE SEPTEMBER 1, 2022 SUBMITTED BY: INITIATING DEPARTMENT: TEJI O'MALLEY, HUMAN RESOURCES AND OFFICE OF THE GENERAL MANAGER - ORGANIZATIONAL DEVELOPMENT HUMAN RESOURCES MANAGER Roger S. Bailey General Manager ISSUE Board approval is required to amend the Secretary of the District's employment agreement. BACKGROUND The employment agreement between the District and Secretary of the District Katherine Young allows for the Board to consider an adjustment to her salary or benefits in such amounts and to such extent as the Board may determine is desirable. The Board evaluated Ms. Young's performance as well as salaries and benefits of comparable positions within the relative labor market and determined an adjustment is warranted. It is proposed that, effective September 1, 2022, Ms. Young's annual salary be increased from $162,795 to $175,005, which reflects an increase of seven and one-half percent. All other provisions of the employment contract, as amended, would remain unchanged. The proposed amendment is provided as Attachment 1. September 1, 2022 Regular Board Meeting Agenda Packet- Page 38 of 86 Page 2 of 3 ALTERNATIVES/CONSIDERATIONS Deny the adjustments for Ms. Young or propose an alternative change. FINANCIAL IMPACTS Ms. Young's annual salary will increase from $162,795.10 to $175,004.73, resulting in an annual cost of $14,462, which includes salary as well as any incremental costs in benefits. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Approve a proposed seven and one-half percent salary increase for Secretary of the District Katherine Young, as set forth in the Sixth Amendment to her February 11, 2018 Employment Agreement, effective September 1, 2022. Proposed Sixth Amendment September 1, 2022 Regular Board Meeting Agenda Packet- Page 39 of 86 Page 3 of 3 SIXTH AMENDMENT TO EMPLOYMENT AGREEMENT This Sixth Amendment to the current Employment Agreement dated February 11, 2018 between the Central Contra Costa Sanitary District ("District"), a special district organized pursuant to the California Sanitary District Act of 1923, and Katherine Young ("Secretary of the District") is entered pursuant to paragraph XI of that Agreement. The Secretary of the District and the District are hereinafter collectively referred to as "the Parties." This Amendment to the Employment Agreement between the Parties contains amendments to the following provisions of that Agreement: Paragraph V.Salary and Benefits. Effective September 1, 2022 the District shall increase the Secretary of the District's annual salary from $162,795.10 to $175,004.73, which reflects an increase of 7.5%. The remaining provisions of paragraph V of the Employment Agreement remain unchanged. Except as expressly stated in this Sixth Amendment, all other provisions of the current Employment Agreement remain in full force and effect. This Sixth Amendment represents all of the agreements between the parties related to this Sixth Amendment, and this may only be modified or amended by an instrument in writing executed by both parties.
