ISSUE
A resolution of the Board of Directors (Board) is required to execute quitclaim deeds for existing
easements and authorizing staff to record the documents with the Contra Costa County Recorder.
BACKGROUND
As part of the South Orinda Sewer Renovations, Phase 8, District Project 8461, Central San's sewer line
was relocated from 7 Lost Valley Drive to existing road right-of-way. Now that that sewer line is no longer
through the property, Central San no longer needs its easement rights and should quitclaim those rights in
order to unencumber the property.

ALTERNATIVES/CONSIDERATIONS
Decline to quitclaim the existing easements that are not in use. This is not recommended since it could
create a cloud on the title of the affected lot and may cause the property owners to seek legal action to
clear the title.
FINANCIAL IMPACTS
None. The quitclaim was planned as part of the South Orinda Sewer Renovations, Phase 8 project.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on August
15, 2022 and recommended approval.
RECOMMENDED BOARD ACTION
Adopt the proposed resolution approving the execution of a quitclaim deed for the Grant of Easement at 7
Lost Valley Drive, Orinda, and authorizing staff to record the documents with the Contra Costa County
Recorder.

A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT
AUTHORIZING EXECUTION OF QUITCLAIM DEED
TO ROLF W. BENSELER AND DONNA K. BENSELER, DISTRICT PROJECT
SOUTH ORINDA RENOVATION PROJECT PHASE 8
PARCEL NO. 2, ORINDA APN 272-230-028
NOW THEREFORE BE IT RESOLVED by the Board of Directors of the Central Contra
Costa Sanitary District (Central San) as follows:
THAT Central San hereby consents to the execution of a Quitclaim Deed to Rolf W.
Benseler and Donna K. Benseler, his wife as joint tenants District Project South Orinda
Renovation Project Phase 8, Parcel No. 2, Orinda dated September 1, 2022; and
THAT the President of the Board of Directors and the Secretary of the District are
hereby authorized to execute said document for and on behalf of Central San; and
THAT staff is authorized to record said document in the Office of the Recorder of Contra
Costa County.
