CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: JULY 21, 2022 SUBJECT: AWARD A CONSTRUCTION CONTRACT IN THE AMOUNT OF $1,140,000 TO ALEX KUSHNER GENERAL, INC., THE LOWEST RESPONSIVE AND RESPONSIBLE BIDDER, FOR THE LABORATORY ROOF AND SEISMIC UPGRADES, DISTRICT PROJECT 100008; AND FIND THE PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITYACT SUBMITTED BY: INITIATING DEPARTMENT: MICHAEL CUNNINGHAM, ASSOCIATE ENGINEERING AND TECHNICAL SERVICES- ENGINEER CAPITAL PROJECTS REVIEWED BY: NATHAN HODGES, SENIOR ENGINEER EDGAR J. Bailey General Manager ISSUE The Board of Directors (Board) must award the contract or reject bids within 50 days of the bid opening. Authorization is also required for the General Manager to execute the Contract Documents subject to submittal requirements. BACKGROUND The Environmental Laboratory Building (Lab) is located within the Martinez campus and is a critical and specialty facility used daily by staff for permitting and regulatory compliance, and process control. I n recent years the roof condition has steadily degraded with several leaks, the most significant of which were in the testing areas of the Lab. July 21, 2022 Regular Board Meeting Agenda Packet- Page 49 of 113 Amended Agenda Page 2 of 6 The Laboratory Roof and Seismic Upgrades, District Project 100008 (Project), will replace the roofing and perform minor structural modifications to upgrade the seismic criteria from the 1994 building code to current design standards. See Attachment 1 for the project location. To accomplish the seismic work in a cost efficient and safe manner, the modifications are designed to be constructed to minimize disruption to sensitive and specialized testing areas and equipment. The majority of structural work will be performed above the ceiling, or from the exterior, and from the roof. The Lab is not expected to be closed during the retrofit and restoration work. In addition, the building HVAC will be modified to allowfor better maintenance access and less disruption to the office area. Central San, Complete Project Solutions (CPS), and Calpo Hom and Dong Architects, Inc. (CH&D) prepared the plans and specifications for the Project. The Engineer's estimate for construction is $900,000. This Project was advertised on June 2 and 9, 2022. Two bids were received and publicly opened on June 27, 2022, which were $1,140,000 and $1,475,000. The Capital Projects Division conducted a technical and commercial review of the bids and determined that Alex Kushner General, I nc. (AK General) is the lowest responsive and responsible bidder. A summary of bids received is shown in Attachment 2. AK General is a contractor based out of San Francisco and meets the qualifications and experience requirements for the Project. The bid price provided byAK General is $240,000 (27%) above the Engineer's estimate. Staff met with AK General and confirmed that the cost difference from the estimate is due to the roofing scope of work. The cost was nearly doubled than anticipated due to the difficult roof access, multiple equipment penetrations, large roof equipment on platforms, and an increased cost of the membrane materials. Central San will administer the construction contract and provide construction management, administration, and submittal review. CPS and CH&D will provide as-needed technical assistance. The general inspection and specialty inspection will be provided under as-needed services agreements in the Capital Program. California Environmental Quality Act (CEQA) Staff has concluded that this Project is exempt from CEQA under Central San CEQA Guidelines Section 15302 because it involves replacement of existing facilities at substantially the same locations and with the same purpose and level of activity as the facilities being replaced. Approval of this Project will establish the Board's independent finding that this Project is exempt from CEQA. ALTERNATIVES/CONSIDERATIONS One alternative is to delay or postpone the Project. This is not recommended as the Lab roof is beyond its useful life and in need of replacement before next winter. Another alternative would be to reject all bids or revise the Project scope and rebid. This is not recommended as seismic upgrades have been designed to be completed in parallel to roof replacement; completing seismic upgrades at a later time would require removing and repairing a section of the new roof. FINANCIAL IMPACTS The total estimated project budget is $1,577,000, which includes planning, design, bid price, contingency, construction management, and consultant costs as detailed in Attachment 3. This Project is included in the Fiscal Year 2022-23 District Budget, shown on page 247, with a total budget of$1,450,000. An additional $127,000 is needed to fund the Project. Staff will transfer the needed amount after Board award, which is under the General Manager's delegation of authority for the Capital Improvement Program. RECOMMENDED BOARD ACTION Staff recommends the following Board action: 1. Find that the Project is exempt from CEQA; 2. Award a construction contract in the amount of$1,140,000 to Alex Kushner General, I nc., the lowest responsive and responsible bidder, for the construction of the Laboratory Roof and Seismic Upgrades, District Project 100008; and 3. Authorize the General Manager to execute the Contract Documents subject to submittal requirements.
