CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER DRAFT MEETING DATE: JULY 20, 2022 SUBJECT: REVIEW DRAFT POSITION PAPER TO ADOPT RESOLUTION 2022- AUTHORIZING A GRANT OF EASEMENT TO CONTRA COSTA WATER DISTRICT FOR ACCESS OVER A PORTION OF THE OUTFALL PROPERTY, 5050 IMHOFF ROAD IN MARTINEZ SUBMITTED BY: INITIATING DEPARTMENT: DAVID KRAMER, SENIOR RIGHT OF WAY ENGINEERING AND TECHNICAL SERVICES - AGENT PDS - DEVELOPMENT SERVICES - RIGHT OF WAY REVIEWED BY: DANA LAWSON, SENIOR ENGINEER DANEA GEMMELL, PLANNING AND DEVELOPMENT SERVICES DIVISION MANAGER JEAN-MARC PETIT, DIRECTOR OF ENGINEERING AND TECHNICAL SERVICES ISSUE Board of Directors (Board) authorization is required to convey real property rights. BACKGROUND Contra Costa Water District (CCW D) requested a 20-foot wide access easement, over land owned in fee by Central San for the Outfall property. CCWD's Shortcut Pipeline Project requires the approximately 2,000 square feet of land for ingress and egress only, and the access easement will not include any rights to store, stage or build any improvements on the property. ALTERNATIVES/CONSIDERATIONS The Board could decline to authorize the access easement to CCW D. However, this is not recommended because the access easement benefits a public utility without impacting Central San's services and CCW D could condemn for the property rights. FINANCIAL IMPACTS CCW D will pay Central San for the access easement based on a market appraisal.
