BACKGROUND Faria Preserve, LLC (Developer) constructed new public sanitary sewers within land dedicated for roadway purposes and within new sanitary sewer easements (SSEs) in San Ramon with Job 6607. The real property interest for roadway was offered from older and new subdivision maps and separate instruments, and the SSE was offered by the Developer from a new subdivision map. As Central San accepted the public sewers constructed with this job, staff recommends the Board accepts the irrevocable offers of dedication. ALTERNATIVES/CONSIDERATIONS July 20, 2022 REEP Committee Meeting Agenda Packet- Page 8 of 53 Page 2 of 6 The Board could decline to accept the irrevocable offers of dedication. This alternative is not recommended as Central San would not have recorded land rights that expressly states Central San has formally accepted the irrevocable offers of dedication to reconstruct, maintain or operate the public sanitary sewers that are owned by Central San. FINANCIAL IMPACTS None as the Developer paid the fees to process these right-of-way documents and to record this resolution. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on July 20, 2022 and recommended RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting irrevocable offers of dedication of real property interests for public sewer purpose and for sanitary sewer easements from Faria Preserve, LLC related to Job 6607 in San Ramon and authorizing staff to record the resolution with the Contra Costa County Recorder.
