BACKGROUND The Mill on Brown, LLC (Developer) constructed a new public sanitary sewer within a new sanitary sewer easement (SSE) in Lafayette with Job 6709. The Developer offered the irrevocable offer of dedication for the SSE to Central San from a subdivision map. As Central San accepted the public sewer constructed with this job, staff recommends the Board accepts the irrevocable offer of dedication. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the irrevocable offers of dedication. This alternative is not recommended as Central San would not have recorded land rights that expressly states Central San has July 20, 2022 REEP Committee Meeting Agenda Packet- Page 4 of 53 Page 2 of 4 formally accepted the irrevocable offers of dedication to reconstruct, maintain or operate the public sanitary sewers that are owned by Central San. FINANCIAL IMPACTS None as the Developer paid the fees to process the right-of-way documents and to record this resolution. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on July 20, 2022 and recommended RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting an irrevocable offer of dedication for a sanitary sewer easement from The Mill on Brown, LLC related to Job 6709 in Lafayette and authorizing staff to record the resolution with the Contra Costa County Recorder. FeetCalifornia State Plane,Zone III FIPS 0403,US Feet July 20, 2022 REEP Committee Meeting Agenda Packet- Page 6 of 53 Page 4 of 4 ATTACHMENT 2 RESOLUTION NO. 2022- A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING A GRANT OF IRREVOCABLE OFFER OF DEDICATION FROM A MAP DEDICATION FOR A SANITARY SEWER EASEMENT FROM THE MILL ON BROWN, LLC AS RELATED TO JOB 6709 IN LAFAYETTE BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby accepts the irrevocable offer of dedication for a sanitary sewer easement from The Mill on Brown, LLC, a California Limited Liability Company as stated in subdivision map, which is more specifically referred to as "Subdivision 9487 — 3408 & 3410 Mt. Diablo, and map was filed on July 15, 2020 in Book 543 of Maps at Pages 22-24 as Document Series 2020-0141386"; and THAT staff is authorized to record this resolution with the Contra Costa County Recorder.
