Alm General Manager District Counsel ISSUE A resolution of the Board of Directors (Board) is required to accept irrevocable offers of dedication for real property interests for public sewer purposes and for sanitary sewer easements interest to Central San and to authorize recording of the resolution. July 7, 2022 Regular Board Meeting Agenda Packet- Page 40 of 137 Page 2 of 5 BACKGROUND OG Property Owner, LLC (Developer) constructed new public sanitary sewers within land dedicated for roadway purposes and within new sanitary sewer easements (SSEs) in Orinda with Job 6423. The real property interest for public roadway was offered from one subdivision map and the SSEs were offered from several subdivision maps. As Central San accepted the public sewers constructed with this job, staff recommends the Board accepts the irrevocable offers of dedication and SSEs that were offered by the Developer. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the irrevocable offers of dedication. This alternative is not recommended as Central San would not have recorded land rights that expressly states Central San has formally accepted the irrevocable offers of dedication to reconstruct, maintain or operate the public sanitary sewers that are owned by Central San. FINANCIAL IMPACTS None as the Developer paid the fees to process these right-of-way documents and to record this resolution. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on June 15, 2022 and recommended approval. RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting irrevocable offers of dedication of real property interests for public sewer purposes and for sanitary sewer easements from OG Property Owner, LLC related to Job 6423 in Orinda and authorizing staff to record the resolution with the Contra Costa County Recorder. Feet California State Plane,Zone III FIPS 0403,US Feet 1 July 7, 2022 Regular Board Meeting Agenda Packet- Page 42 of 137 Page 4 of 5 ATTACHMENT 2 RESOLUTION NO. 2022-032 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING GRANTS OF IRREVOCABLE OFFERS OF DEDICATIONS FROM MAP DEDICATIONS FOR REAL PROPERTY INTERESTS FOR PUBLIC SEWER PURPOSES AND FOR SANITARY SEWER EASEMENTS FROM OG PROPERTY OWNER, LLC, AS RELATED TO JOB 6423 IN ORINDA BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby accepts the irrevocable offer of dedication made to the local agency for real property interest for public street and utility purposes, including public sewer purposes, from OG Property Owner, LLC, as stated in subdivision map, which is more specifically referred to as "Subdivision 9074, Wilder - Phase 1, and map was filed on July 22, 2008 in Book 507 of Maps at Pages 11-60 as Document Series No. 08- 162764, as ROW Parcel 2 — 6423", and THAT Central San hereby accepts the sanitary sewer easements offered to Central San from OG Property Owner, LLC as ROW Parcel 1 - 6423 from the following filed subdivision maps: Subdivision Subdivision Name Recording (date) 9074 Wilder - Phase 1 507 M 11 (7/22/2008) 9222 Wilder - Phase II 518 M 29 (12/12/2013) 9223 Wilder - Phase 111 527 M 45 (3/11/2016) 9224 Wilder - Phase IV 522 M 32 (12/24/2014) THAT staff is authorized to record this resolution with the Contra Costa County Recorder.
