ISSUE
Section 6490 of the Health and Safety Code of the State of California provides that District ordinances
shall be published once in a newspaper of general circulation within the District, and further stipulates a
subsequent order of the Board that the ordinance had been published shall constitute conclusive evidence
that publication has been properly made.
BACKGROUND
Summaries of three uncodified District Ordinances were published on June 23, 2022 in the Contra Costa
Times and San Ramon Valley Times, circulation areas of the East Bay Times.
Ordinance No. 321, adopted on June 2, 2022, updated the Schedule of Environmental and Development-
Related Fees and Charges, pursuant to District Code Chapter 6.20. The publication included a tally of
increased, decreased, and unchanged fees reflected in the new schedule.

Ordinance No. 324, adopted on June 16, 2022, updated the Schedule of Capacity Fees, Rates and
Charges, pursuant to District Code Chapter 6.12. The new schedule included an increase of the gravity
capacity fees and pumping capacity fees per residential unit equivalent.
Ordinance No. 325, also adopted on June 16, 2022, established a 2022 version update of the District's
Standard Specifications for Design and Construction in accordance with District Code Chapter
9.08.010.The specifications are available online, as well as a viewing copy on file with the Secretary of the
District's office.
These summaries were published in a timely fashion in order for each ordinance to become effective July
1, 2022.
ALTERNATIVES/CONSIDERATIONS
Confirming publication of the ordinance summaries establishes presumption that the ordinances were
correctly published and therefore would be deemed procedurally valid by a court.
FINANCIAL IMPACTS
Minimal cost associated to publication fees.
