Alm General Manager District Counsel ISSUE Section 6490 of the Health and Safety Code of the State of California provides that District ordinances shall be published once in a newspaper of general circulation within the District, and further stipulates a subsequent order of the Board that the ordinance had been published shall constitute conclusive evidence that publication has been properly made. BACKGROUND Summaries of codified District Ordinance Nos. 322 and 323, which were adopted by the Board on June 2, 2022, were published on June 9, 2022 in the Contra Costa Times and San Ramon Valley Times, circulation areas of the East Bay Times. Ordinance No. 322 amended various chapters of the District Code in Titles 1, 2, 4, 5, 6, 7, 9, and 11. Similarly, Ordinance No. 323 amended various chapters, but within District Code Title 10 only. These District Code updates became effective June 17, 2022. July 7, 2022 Regular Board Meeting Agenda Packet- Page 26 of 137 Page 2 of 6 ALTERNATIVES/CONSIDERATIONS Confirming publication of the ordinance summary establishes presumption that the ordinance was correctly published and therefore would be deemed procedurally valid by a court. FINANCIAL IMPACTS Minimal cost associated to publication fees. COMMITTEE RECOMMENDATION This item was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Confirm the publication of the summaries for codified Ordinance No. 322 and Ordinance No. 323, respectively.
